COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 981464

 

Approving an amendment to a previously approved Community Unit Project on approximately a 28.32 acre tract of land generally located on the east side of Noland Road, approximately 600 feet south of U.S. Highway 40. (9650-CUP-13)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved Community Unit Project on approximately a 28.32 acre tract of land generally located on the east side of Noland Road, approximately 600 feet south of U.S. Highway 40, and more specifically described as follows:

 

All that part of the SE 1/4, Section 26, Township 49, Range 32, Kansas City, Jackson County, Missouri, being described as follows: Beginning at the northeast corner of said SE 1/4; thence North 87 06'23" West along the north line of said SE 1/4, 1321.28 to the northeast corner of the NW 1/4 of said SE 1/4, said corner being the northwest corner of Heuler Heights, a subdivision in said Kansas City; thence South 2 05'47" West along the east line of said NW 1/4 and the west line of said Heuler Heights, 47.43 feet to a point on the south right of way line of U.S. Highway 40; thence continuing along west line of said Heuler Heights South 2 05'47" West, 774.35 feet; said point being the true point of beginning of the tract to be described herein; thence continuing along said line South 2 05'47" West, 427.82 feet; thence South 87 9'15" East, 305.37 feet; thence South 2 05'38" West, 74.21 feet, said corner being on the north line of the SE 1/4 of said SE 1/4; thence South 87 08'06" East along said north line, 25.00 feet to the west line of Sni-A-Bar Addition, a subdivision in said Kansas City; thence South 2 05'38" West along said west line, 661.77 feet to a point on the north line of the S 1/2, S 1/2 of said SE 1/4. Said point being also the northeast corner of a certificate of survey recorded in Book T-1 at page 18; thence North 87 08'49" West along said north line, 1133.04 feet to the east right of way line of Noland Road; thence North 27 00'34" West along said line, 40.00 feet from the centerline thereof, 316.24 feet; thence North 62 59'26" East, 5.00 feet; thence North 27 00'34" West, 100.00 feet; thence South 62 59'26" West, 5.00 feet; thence North 27 00'34" West, 120.00 feet; thence North 62 59'26" East, 345.00 feet; thence North 2 05'47" East, 580.00 feet; thence South 63 54'57" East, 155.39 feet; thence South 87 54'13" East, 620.00 feet to the true point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 


3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer extend water mains as required by the Water Services Department.

 

6. That the developer provide for fire protection as required by the Fire Department.

 

7. That the developer submit a street tree planting plan with the final plats and secure the approval of the City Forest with a copy to be submitted to the Department of City Development. The street tree planting plan shall include size, type, spacing and species of trees.

 

8. That the developer extend sanitary sewers as required by the Department of Public Works.

 

9. That the developer secure the approval of the Street Naming Committee for all street names prior to the submittal of the first final plat.

 

10. That the developer dedicate additional right of way for Hocker Road as required by the Department of Public Works so as to provide a total of 60 feet of right of way as measured from the centerline of Hocker Road.

 

11. That the developer dedicate additional right of way for Emery Avenue as required by the Department of Public Works so as to provide a total of 25 feet of right of way as measured from the centerline of Emery Avenue.

 

12. That the developer secure the approval of the Missouri Department of Transportation for access onto Noland Road.

 

13. That the developer improve Hocker Road to divided collector street standards as required by the Department of Public Works, including construction of curbs, gutters, and sidewalks and installation of streetlights.

 

14. That the developer improve one-half of Emery Avenue to residential street standards as required by the Department of Public Works, including construction of curbs, gutters, sidewalks and installation of streetlights.

 

15. That the developer construct 49th Street to residential street standards from Hocker Road to Emery Avenue with the first phase of the single-family residential units as required by the Department of Public Works, including construction of curbs, gutters, sidewalks and installation of streetlights.

 

16. That the developer construct on-site/off-site temporary cul-de-sacs as required by the Department of Public Works.

 

17. That the developer secure the approval of the Missouri Department of Transportation prior to working in any State right of way.

 

18. That the developer receive the approval of the Board of Zoning Adjustment for any monument signage.

 

19. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading and signage, prior to the issuance of a building permit.

 

A copy of said Community Unit Project amendment is on file in the office of the City Clerk under Document No. 981464, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
