ORDINANCE NO. 970942

 

Approving a Community Unit Project on approximately an 11.6 acre tract of land generally located east of N. Robinhood Lane at N.W. 71st Terrace. (11982-CUP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on approximately an 11.6 acre tract of land generally located east of N. Robinhood Lane at N.W. 71st Terrace, and more specifically described as follows:

 

A tract of land situated in the NW 1/4, Section 21, Township 51, Range 33, Kansas City, Platte County, Missouri, described as follows: Beginning at a point on the west line of said NW 1/4, said point being North 00 25'47" East, along said line, 2039.06 feet from the southwest corner of said NW 1/4, said point also being the northwest corner of Townsend Circle - Second Plat, a subdivision in said Kansas City; thence North 00 25'47" East, continuing along said line, 491.48 feet to a point that is 100.00 feet south of the northwest corner of said NW 1/4, said point being the southwest corner of a tract of land described in Book 458 at page 174 recorded in the Recorder's Office of said Platte County; thence South 89 05'31" East, along the southerly line of said tract, 70.00 feet; thence South 52 35'25" East, continuing along said line, 249.45 feet (Deed = 260.00 feet); thence South 68 05'31" East, continuing along said line and along the southerly line of a tract described in Book 838 at page 734 recorded in the Recorder's Office of said Platte County, 790.20 feet; thence South 01 07'05" East, departing from said line, 642.11 feet to the north right of way line of vacated N.W. 70th Street Terrace; thence South 88 48'44" West, along said line, 46.85 feet; thence northwesterly, continuing along said line and along the northerly line of said Townsend Circle - Second Plat, along a curve to the right having a radius of 250.13 feet and tangent to the last described course, an arc distance of 261.85 feet; thence North 31 07'05" West, along the northerly line of said Townsend Circle - Second Plat, 144.05 feet; thence northwesterly, continuing along said line, along a curve to the left having a radius of 277.88 feet and tangent to the last described course, an arc distance of 99.19 feet; thence North 51 34'13" West, continuing along said line, 407.86 feet; thence northwesterly, continuing along said line, along a curve to the left having a radius of 118.21 feet and tangent to the last described course, an arc distance of 78.40 feet; thence North 88 34'13" West, continuing along said line, 220.00 feet to the point of beginning, subject to that part on the west now being used for public road purposes. Containing approximately 507,300 square feet or 11.6 acres.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer construct any improvements as required by the City

Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer dedicate additional right of way for N. Robinhood Lane as required by the Department of Public Works so as to provide a total of 30 feet of

right of way as measured from the centerline of N. Robinhood Lane.

 

6. That the developer improve one-half of N. Robinhood Lane to collector street standards as required by the Department of Public Works.

 

7. That the developer extend sanitary sewers as required by the Department of Public Works.

 

8. That the developer extend water mains as required by the Water Services Department.

 

9. That the developer construct all-weather roads and provide for fire protection as required by the Fire Department prior to construction beyond footings and

foundations.

 

10. That the developer submit a street tree planting plan with the final plat and secure the approval of the City Forester for street trees planted on right of way in front of

residential lots, with a copy to be submitted to the City Development Department.

The plan shall include size, type, species and placement of trees.

 

11. That the developer submit a street name signage plan to the Street Naming Committee for approval prior to submittal of the first final plat.

 

12. That the developer show the limits of the 100 year floodplain on the final plat as required by the Department of Public Works.

 

13. That the developer secure a floodplain certificate if any grading is to occur within a floodplain.

 

14. That the developer complete a Phase I environmental audit for the parkland to be dedicated to the City.

 

15. That the developer submit a certificate of survey prior to the sale of individual lots or units to the Department of City Development for approval.

 

16. That the submit a final plan to the City Plan Commission for approval, including: site plan; dimension plan; grading plan; landscaping and planting plan; and location

of and details on signage (including elevations).

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 970942, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
