ORDINANCE NO. 920377, AS AMENDED

Approving the Second Amendment to the Development Plan submitted by B.C.R. Redevelopment Corporation and authorizing the Director of Finance to execute a supplemental contract.

WHEREAS, B.C.R. Redevelopment Corporation, an urban redevelopment corporation of Missouri, organized under, and pursuant to, the Urban Redevelopment Corporations Act of 1945, as amended, did on March 4, 1988, file with the City Clerk an application for approval of a development plan which was approved by the Council by Committee Substitute for Ordinance No. 64436, passed February 2, 1989; and

WHEREAS, B.C.R. Redevelopment Corporation did file a First Amendment with the City Clerk which was not approved by the Council by virtue of Ordinance No. 910222 receiving five (5) "aye" votes and eight (8) "nay" votes resulting in the ordinance deemed to have been "lost" on April 4, 1991; and

WHEREAS, B.C.R. Redevelopment Corporation did on January 31, 1992, file with the City Clerk an application for a Second Amendment to the Development Plan; and

WHEREAS, the City Clerk did refer said Second Amendment to the City Plan Commission; and

WHEREAS, the City Plan Commission did cause notice to be published in the Daily Record, a newspaper doing the City's printing, on February 17, 1992, said date being at least ten (10) days prior to the date of the public hearing; and

WHEREAS, pursuant to said public notice, a public hearing was held on March 3, 1992, and continued to March 17, 1992, at which time all persons interested were given an opportunity to present testimony; and

WHEREAS, the City Plan Commission has made an independent study and investigation of the proposed Second Amendment to the Development Plan and did recommend approval of said Second Amendment to the Development Plan, and said City Plan Commission has filed with the City Clerk a report recommending approval of said proposed amendment to the Development Plan, said report being attached hereto as Exhibit "A" and incorporated herein by reference; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the application for approval of a Second Amendment to the Development Plan by B.C.R. Redevelopment Corporation, which is hereby incorporated herein by reference, is approved as an amendment to the Development Plan as originally approved by Committee Substitute for Ordinance No. 63346, passed February 2, 1989.

Section 2. That the Council hereby finds and declares that good cause has been shown for the approval of said Second Amendment to the Development Plan of B.C.R. Redevelopment Corporation and that the findings and declarations made by the Council in Section 2 of Committee Substitute for Ordinance No. 63346 have not been affected by the amendment thereto and equally apply to said Development Plan, as amended.

Section 3. That the Council hereby finds and determines that the public convenience and necessity will be served by the Development Plan, as amended.

Section 4. That the Director of Finance be, and he is hereby, authorized and directed on behalf of the City to enter into a First Supplemental Contract with B.C.R. Redevelopment Corporation, a copy of which in substantial form is attached hereto as Exhibit "B" and is incorporated herein by reference.
