Approving
an amendment to a previously approved preliminary plan in District CP-3 (Regional
Planned Business Center) on approximately a 15.4 acre tract of land generally
located at the northeast corner of N.W. Englewood Road and U.S. 169 Highway.

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That an amendment to a previously approved preliminary plan in District
CP-3 (Regional Planned Business Center) on approximately a 15.4 acre tract of
land generally located at the northeast corner of N.W. Englewood Road and U.S.
169 Highway, and more specifically described as follows:
A tract of land in the Southeast Quarter of
Section 27, Township 51, Range 33, Clay County, Missouri lying within the
corporate limits of Gladstone, Missouri and Kansas City, Missouri being bounded
and described as follows: Commencing at the southeast corner of the Southeast
Quarter of said Section 27; thence North 0E40'32"
East along the east line of said Southeast Quarter, 635.00 feet; thence North
89E14'01" West
parallel to the south line of said Southeast Quarter 40.00 feet to a point on
the west right-of-way line of N. Broadway, as now established, said point being
the true point of beginning of the tract to be herein described; thence North
89E14'01" West along
said line of said Southeast Quarter 523.62 feet; thence North 0E40'32" East parallel to the east
line of said Southeast Quarter, 300.00 feet; thence North 89E14'01" West parallel to the south
line of said Southeast Quarter 473.16 feet to a point on the east right-of-way
line of U.S. Highway Route No. 169, as now established; thence South 1E10'31" West along said right-of-way
line, 512.07 feet; thence South 11E16'16"
East continuing along said right-of-way line 370.70 feet to a point on the
north line of Englewood Road, as now established; thence South 89E56'01" East along said north line,
150.00 feet; thence South 1E10'34"
West, 12.23 feet; thence South 89E14'01"
East parallel to the south line of said Southeast Quarter along the north line
of said Englewood Road, 196.69 feet; thence easterly continuing along said
right-of-way line on a curve to the left, tangent to the last described course,
having a radius of 831.47 feet, an arc distance of 357.96 feet; thence North 66E05'59" East along said right-of-way
line, tangent to the last described curve, 211.94 feet; thence North 40E16'27" East along said right-of-way
line of said N. Broadway; thence North 0E40'32"
East along said right-of-way line, 374.60 feet to the true point of beginning.
Containing 15.43 acres, more or less. Subject to any and all easements and
restrictions of record.

hereby approved, subject to the following conditions:
1. That
the developer submit an updated storm drainage study for the overall
development to the City Engineers Office for approval prior to issuance of
building permits and that the developer construct any improvements as required
by the City
Engineers
Office.
2. That the developer secure the
approval of the Board of Zoning Adjustment of a variance to the required number
of off-street parking spaces for the expanded commercial center, plus any other
necessary variances.
3. That the developer submit a
final plan to the City Plan Commission for approval, including detailed
information on grading, building elevation, landscaping, lighting, fencing and
signage (including elevations).
A copy of said amendment is
on file in the office of the City Clerk under Document No. 030145, which is
attached hereto and made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
