ORDINANCE NO. 000289
Approving
an amendment to a previously approved preliminary plan in District M-1-p (Light
Industry - Limited District) on an approximately 18 acre tract of land
generally located at the northwest corner of N.E. Cookingham Drive (Missouri
Highway 291) and N.E. 108th Street. (6093-P-12)
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That an amendment to a previously approved preliminary plan in District
M-1-p (Light Industry - Limited District) on an approximately 18 acre tract of
land generally located at the northwest corner of N.E. Cookingham Drive
(Missouri Highway 291) and N.E. 108th Street, and more specifically described
as follows:
All of Lots 1, 2, 3, 4, 5, 6, and 7, Pioneer
Industrial Park - I, a subdivision in Kansas City, Clay County, Missouri.
is
hereby approved, subject to the following conditions:
1. That
the developer cause Lot 1 to be replatted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations, as determined necessary
by the City Engineers Office.
2. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer make any necessary improvements as required by
the City Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer extend water mains as required by the Water Services Department.
5. That
the developer provide for fire protection as required by the Fire Department.
6. That
the developer dedicate additional right of way for N.E. 108th Street as
required by the Department of Public Works so as to provide a total of 50 feet
of right of way as measured from the centerline of N.E. 108th Street prior to
the issuance of a building permit for Lot 4, as shown on the preliminary plan.
7. That
the developer improve one-half of N.E. 108th Street to primary arterial street
standards as required by the Department of Public Works, including construction
of sidewalks and installation of streetlights, prior to the issuance of a
building permit for Lot 4.
8. That the developer secure a land
disturbance permit from the Department of Public Works prior to beginning any
construction, grading, clearing or grubbing activities, if the disturbed area
exceeds one acre.
9. That the developer secure a
land disturbance permit from the Missouri Department of Natural Resources.
10. That the developer secure the
approval of the Missouri Department of Transportation prior to working in any
State right of way.
11. That the developer provide for
cross-access easements between Lots 1, 5, 6 and 7 within the development as
shown on the preliminary plan as required by the Department of Public Works
prior to the issuance of any building permits for Lots 1, 5, 6 and 7.
12. That the developer receive the
approval of the Missouri Department of Transportation for access onto N.E.
Cookingham Drive (Missouri Highway 291) prior to the issuance of any building
permits for Lots 1, 5, 6 and 7.
13. That the developer submit a
final plan to the City Plan Commission for approval, including plans for
landscaping, grading and signage, prior to the issuance of any building permits
for each phase of the development.
A copy of said amendment is
on file in the office of the City Clerk under Document No. 000289, which is
attached hereto and made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
