ORDINANCE NO. 010476

 

Approving the preliminary plat of The Vineyards on approximately a 31.5 acre tract of land generally located on the north side of N.W. 68th Street and on the east side of N. Bell Street (future N. Platte Purchase Drive). (SD 0917)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of The Vineyards on approximately a 31.5 acre tract of land generally located on the north side of N.W. 68th Street and on the east side of N. Bell Street (future N. Platte Purchase Drive), and more specifically described as follows:

 

Lot 13, Eureka Farms, a subdivision in Kansas City, Clay County, Missouri, according to the recorded plat thereof and a part of the Northwest Fractional Quarter of Section 22, Township 51, Range 33, in Kansas City, Clay County, Missouri, described as follows: Beginning at the northwest corner of said Fractional Quarter; thence east, along the north line of said Fractional Quarter, 826.84 feet to the north corner common to Lots 14 and 15, in Eureka Farms, a subdivision according to the recorded plat thereof, said point being also the approximate centerline of Line Creek; thence southwesterly, along the west line of said Eureka Farms and the centerline of said Line Creek to the northwest corner of Lot 13 in said Eureka Farms, which is a point on the west line of said Fractional Quarter; thence north, 2433.78 feet to the point of beginning. Containing approximately 1,374,350 square feet or 31.5507 acres.

 

Note: The above description was copied from a Sheriffs Deed recorded in Book 2143 at page 701 in the Recorders Office of Clay County, Missouri, and a title report by Stewart Title Incorporated, Commitment No. 99090828 A, effective date of September 29, 1999 at 8:00 a.m.

 

Note: The west line of Eureka Farms is now the west line of Brookshire - Third Plat and Westgate Meadows.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval at the time the final plat is submitted and that the developer make any improvements as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.


4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer extend water mains as required by the Water Services Department.

 

7. That the developer construct hard surface all-weather roads and provide for fire protection as required by the Fire Department.

 

8. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

9. That the developer extend sanitary sewers as required by the Department of Public Works.

 

10. That the developer dedicate right of way for N. Platte Purchase Drive as required by the Department of Public Works so as to provide 40 feet of right of way as measured from the centerline of N. Platte Purchase Drive.

 

11. That the developer improve the east side of N. Platte Purchase Drive to secondary arterial street standards as required by the Department of Public Works, including construction of curbs, gutter and sidewalks and installation of streetlights, or enter into an Agreement with the City as required by the Department of Public Works whereby the developer agrees to contribute a total of $341,023.00 ($134.00 per front foot) for the improvement of N. Platte Purchase Drive.

 

12. That the developer submit a street name signage plan to the Street Naming Committee for approval for all street names prior to the submittal of the final plat.

 

13. That the developer secure the approval of the Board of Zoning Adjustment for any proposed neighborhood identification signs prior to the issuance of a sign permit.

 

14. That the developer construct a temporary cul-de-sac at the north end of the proposed north/south street, west of N. Liberty Street, as required by the Department of Public Works.

 

15. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of the private open space and any detention areas.

 

16. That the developer show no lots or street right of way within the floodplain on any final plats.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 010476, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
