Approving
an amendment to a previously approved Community Unit Project on an approximately
86.3 acre tract of land generally located at the northwest corner of Little
Blue Road and Lees Summit Road. (10177-CUP-9)

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That an amendment to a previously approved Community Unit Project on an
approximately 86.3 acre tract of land generally located at the northwest corner
of Little Blue Road and Lees Summit Road, and more specifically described as
follows:
All that part of the Northeast Quarter of
Section 13, Township 48, Range 32 and all that part of the Northwest Quarter of
Section 18, Township 48, Range 31, all in the Kansas City, Jackson County,
Missouri, described as follows: Commencing at the southeast corner of said
Northeast Quarter; thence North 86E56'55"
West along the south line of said Quarter Section and 20 feet north of and
parallel with the centerline of Gregory Boulevard, a distance of 790.33 feet to
the true point of beginning; thence continuing North 86E56'55" West along said south line, a
distance of 1772.97 feet to the southwest corner of said Section 13; thence
North 01E47'15" East along
the west line of said Quarter Section said west line being 20 foot distant and
parallel with the centerline of Little Blue Road, a distance of 907.87 feet;
thence South 86E51'51" East, a
distance of 1043.55 feet; thence North 01E47'15"

the point of beginning, containing 86.3 acres except that part in street
right-of-way.
is
hereby approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval and that the developer construct any
improvements as required by the City Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineer's Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
5. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
6. That
the developer dedicate additional right of way for Lees Summit Road as
required by the Department of Public Works so as to provide a total of 40 feet
of right of way as measured from the centerline of Lees Summit Road.
7. That
the developer improve the west half of Lees Summit Road to secondary arterial
street standards as required by the Department of Public Works, including
construction of sidewalks and including improvement of the frontage along the
property at 7730 Lees Summit Road as shown on the Community Unit Project plan.
8. That
the developer dedicate additional right of way for Gregory Boulevard (Little
Blue Road) as required by the Department of Public Works so as to provide a
total of 75 feet of right of way as measured from the centerline of Gregory
Boulevard (Little Blue Road).
9. That
the developer improve the north half of Gregory Boulevard (Little Blue Road) to
parkway street standards as required by the Department of Public Works.
10. That
the developer construct a street connection to Lees Summit Road with the
approval of the next final plat.
11. That
the developer contribute $18,351.00 in lieu of parkland dedication for 92 units
(92 x 3.7 x .006 x $12,811.37 year 2000 rate = $26,165.94 less $7,814.94 credit
for 0.61 acres of private open space provided) in satisfaction of Section
66-128 of the Subdivision Regulations.
12. That
the developer install hard surface roads and provide for fire protection as
required by the Fire Department prior to construction beyond foundations.
13. That
the developer extend water mains as required by the Water Services Department.
14. That
the developer submit a street name signage plan for all street names to the
Street Naming Committee for approval prior to the submittal of the next final
plat.
15. That
the developer construct temporary cul-de-sacs as required by the Department of
Public Works.
16. That
the developer submit conditions, covenants and restrictions to the Law
Department for approval for the maintenance of private open space and any
detention areas.
17. That
the developer submit a street tree planting plan as part of the final plat with
a copy to be submitted to the Department of City Development, secure the
approval of the City Forester for street trees planted on right of way in front
of residential lots, and plant the street trees in conformance with the plan
approved by the City Forester. The plan shall include size, type, species and
placement of trees.
18. That
the developer install street trees as approved by the City Forester in front of
all platted lots in Summit Word, Summit Wood Second Plat and Summit Wood Third
Plat for which a certificate of occupancy has been issued prior to the approval
of any further final plats.
19. That
the developer submit a final plan to the City Plan Commission for approval,
including plans for landscaping, grading, signage (including elevations) and
building elevations.
A
copy of said Community Unit Project plan is on file in the office of the City
Clerk under Document No. 010447, which is attached hereto and made a part
hereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed Community Unit Project hereinabove, all public notices and hearings
required by the Zoning Ordinance have been given and had.
