COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 990280

 

Vacating part of the northwest and northeast corners of 4th Street and Forest Avenue; and part of the northwest corner of 5th Street and Lydia Avenue dedicated by Guinotte Manor, a subdivision in Kansas City, Jackson County, Missouri, and all utility easements, except for a sewer easement over, under, along and across said portions of right of way. (1281-V)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. The Council of Kansas City does hereby find and declare that on the 7th day of January, 1999, a petition was filed with the City Clerk of Kansas City by Housing Authority of Kansas City, Missouri, for the vacation of part of northwest and northeast corners of 4th Street and Forest Avenue; and part of the northwest corner of 5th Street and Lydia Avenue dedicated by Guinotte Manor, a subdivision in Kansas City, Jackson County, Missouri, described as follows: Beginning at the point of curvature on the north right-of-way line 4th Street and the westerly right of way line of Forest Avenue, said point being on a curve concave to the northwest having a radius of 175.83 feet; thence northeasterly 236.48 feet along said curve to the left and said right of way line having a chord bearing North 5152'15" East 219.05 feet; thence South 1320'30" West 105.77 feet to the beginning of a curve concave to the northwest having a radius of 43.00 feet; thence southwesterly 57.83 feet along said curve to the right having a chord bearing South 5152'15" West 53.57 feet; thence North 8936'00" West 105.77 feet to the point of beginning, and also beginning at the point of curvature on the east right-of-way line of Forest Avenue lying North of 4th Street, said point being on a curve concave to the northeast having a radius of 60.46 feet; thence southeasterly 74.82 feet along said curve to the left and said right-of-way line having a chord bearing South 2206'36" East 70.14 feet; thence South 5733'43" East 12.11 feet; thence North 8936'00" West 30.88 feet to the beginning of a curve concave to the northeast having a radius of 18.00 feet; thence northwesterly 32.34 feet along said curve to the right having a chord bearing North 3807'45" West 28.16 feet; thence North 1320'30" East 50.47 feet to the point of beginning, and also beginning at the point of curvature on the north right-of-way line of 5th Street and the westerly right-of-way line of Lydia Avenue, said point being on a curve concave to the northwest having a radius of 102.00 feet; thence northeasterly 170.84 feet along said curve to the left and said right-of-way line having a chord bearing North 4026'00" East 151.56 feet; thence South 733'00" East 49.73 feet to the beginning of a curve concave to the northwest having a radius of 57.20 feet; thence southwesterly 95.81 feet along said curve to the right having a chord bearing South 4026'00" West 84.99 feet; thence South 8825'00" West 49.73 feet to the point of beginning; and all utility easements, except for a sewer easement over, under, along and across said portions of right-of-way, all in Section 33-50-33, giving the distinct description of the right-of-way to be vacated, and also the names of the persons and corporations owning or claiming to own the property fronting thereon, and that due notice of the pendency of said petition has been given for twenty (20) days in the newspaper doing the city printing, and that the consent of the persons and corporations owning or claiming to own three‑fourths of the front feet of the property immediately adjoining said right-of-way has been obtained in writing, that said consent has been acknowledged as deeds are acknowledged, and was duly filed with the petition for such vacation in the City Clerk's Office.

 


Section 2. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.

 

Section 3. That of part of northwest and northeast corners of 4th Street and Forest Avenue; and part of the northwest corner of 5th Street and Lydia Avenue dedicated by Guinotte Manor, a subdivision in Kansas City, Jackson County, Missouri, described as follows: Beginning at the point of curvature on the north right-of-way line 4th Street and the westerly right of way line of Forest Avenue, said point being on a curve concave to the northwest having a radius of 175.83 feet; thence northeasterly 236.48 feet along said curve to the left and said right of way line having a chord bearing North 5152'15" East 219.05 feet; thence South 1320'30" West 105.77 feet to the beginning of a curve concave to the northwest having a radius of 43.00 feet; thence southwesterly 57.83 feet along said curve to the right having a chord bearing South 5152'15" West 53.57 feet; thence North 8936'00" West 105.77 feet to the point of beginning, and also beginning at the point of curvature on the east right-of-way line of Forest Avenue lying North of 4th Street, said point being on a curve concave to the northeast having a radius of 60.46 feet; thence southeasterly 74.82 feet along said curve to the left and said right-of-way line having a chord bearing South 2206'36" East 70.14 feet; thence South 5733'43" East 12.11 feet; thence North 8936'00" West 30.88 feet to the beginning of a curve concave to the northeast having a radius of 18.00 feet; thence northwesterly 32.34 feet along said curve to the right having a chord bearing North 3807'45" West 28.16 feet; thence North 1320'30" East 50.47 feet to the point of beginning, and also beginning at the point of curvature on the north right-of-way line of 5th Street and the westerly right-of-way line of Lydia Avenue, said point being on a curve concave to the northwest having a radius of 102.00 feet; thence northeasterly 170.84 feet along said curve to the left and said right-of-way line having a chord bearing North 4026'00" East 151.56 feet; thence South 733'00" East 49.73 feet to the beginning of a curve concave to the northwest having a radius of 57.20 feet; thence southwesterly 95.81 feet along said curve to the right having a chord bearing South 4026'00" West 84.99 feet; thence South 8825'00" West 49.73 feet to the point of beginning; and all utility easements, except for a sewer easement over, under, along and across said portions of right-of-way, all in Section 33-50-33, be and the same is hereby vacated. However, the City of Kansas City reserves an easement and the right to locate, construct and maintain (or to authorize any franchised utility to locate, construct and maintain) sewer pipes over, under, along and across the above‑described property. The City of Kansas City shall have at all times the right to go upon the above‑described property to construct, maintain and repair the same; and nothing in this vacation action shall be construed so as to grant any right to use the above‑described property in any manner as would interfere with the construction or reconstruction and proper, safe and continuous maintenance of the aforesaid use, and specifically, there shall not be built thereon or thereover any structure (except driveways, paved areas, grass, shrubs and fences) without first securing the written approval of the Director of Public Works.

 

Section 4. That the City Clerk of Kansas City, Missouri, be and she is hereby authorized and directed to acknowledge this ordinance as deeds are acknowledged, and to cause this ordinance and the consent of property owners hereinbefore referred to, to be filed for record in the Recorder's Office in Jackson County, Missouri.

 

Section 5. All Ordinances or parts of Ordinances in conflict with this Ordinance are, in so much as they conflict with this Ordinance, hereby repealed.
