ORDINANCE NO. 030897

Accepting various easements and deeds in Clay County; releasing easements in Clay County; and directing the City Clerk to record the acceptance.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That various easements and deeds in Kansas City, Clay County, executed by the following persons, and which appear of record as the instrument numbers and respective books and pages as follows:

 

1. Storm Drainage Easement from Hunt Midwest Real Estate Development, Inc., Instrument No. R61886, Book 3941, page 640;

 

2. Standard Sewer Easement from Hunt Midwest Real Estate Development, Inc., Instrument No. R61887, Book 3941, page 642;

 

3. Storm Drainage Easement from Hunt Midwest Real Estate Development, Inc., Instrument No. R61889, Book 3941, page 646;

and described in Exhibit A, which is attached hereto and incorporated herein by reference, all recorded in the office of the Recorder of Deeds for Clay County, Missouri, at Liberty, are hereby accepted. That upon the effective date of this Ordinance, the City Clerk is hereby directed to cause this Ordinance and Exhibit A to be recorded in the office of the Recorder of Deeds for Clay County, Missouri, at Liberty.

 

Section 2. That the Standard Sewer Easement for storm drainage purposes granted to the City by Document No. C41269, Book 1032, page 209, described as follows: Commencing at the northeast corner of the Southwest Quarter of the Southeast Quarter of Section 2, Township 50 North, Range 33 West; thence North 89E23'06" West, along the north line of the Southwest Quarter of said Southeast Quarter a distance of 1138.86 feet; thence South 00E36'54" West, a distance of 37.13 feet to the point of beginning; thence South 12E26'24" East, a distance of 159.03 feet; thence North 77E33'36" East, a distance of 32.00 feet; thence South 12E26'24" East, a distance of 61.96 feet; thence South 25E50'28" West, a distance of 21.00 feet; thence North 89E38'34" West, a distance of 84.31 feet; thence North 52E08'21" West, a distance of 3.98 feet; thence North 25E50'28" East, a distance of 20.60 feet; thence North 12E26'24" West, a distance of 40.53 feet; thence North 77E33'36" East, a distance of 33.00 feet; thence North 12E26'24" West, a distance of 138.96 feet; thence North 32E27'11" East, a distance of 28.34 feet to the point of beginning, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

That the Storm Drainage Easement granted to the City by Document No. G48329, Book 1033, page 376, described as follows: Commencing at the northwest corner of the Southwest Quarter of the Southeast Quarter of said Section 2; thence South 00E21'26" West (South 00E25'19" West-Deeded) along the west line of the Southwest Quarter of the Southeast Quarter of said Section 2, a distance of 176.36 feet; thence South 89E30'46" East (South 89E32'13" East-Deeded), a distance of 78.34 feet to the point of beginning; thence continuing South 89E30'46" East (South 89E32'13" East-Deeded), a distance of 108.94 feet; thence South 47E31'32" East (South 47E32'59" East-Deeded) a distance of 26.91 feet; thence South 00E29'14" West (South 00E27'47" West-Deeded) a distance of 70.41 feet; thence North 89E38'34" West, a distance of 54.96 feet; thence North 52E08'21" West, a distance of 110.13 feet; thence North 32E27'11" East, a distance of 25.57 feet to the point of beginning, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.
