ORDINANCE NO. 091045

 

Authorizing the Director of Water Services Department to enter into an $89,445.75 contract with Kincaid Construction, Inc. for Contract No. 967, Project No. 89003730, Sanitary Sewer Improvement – N.E. 52nd Street and Randolph Road, a Transform Missouri - American Recovery and Reinvestment Act Project; authorizing the Director of Water Services to expend $98,390.33 for the project from previously appropriated funds; authorizing the Director of Finance to return unexpended appropriations to the appropriate account; assessing the properties benefited; and recognizing an emergency.

 

WHEREAS, the U.S. Congress approved the American Recovery and Reinvestment Act (ARRA) of 2009, and the President signed the Act into law on February 17, 2009, providing $4 billion in federal funding to cities and communities for eligible wastewater and stormwater infrastructure improvements through the Clean Water State Revolving Fund (CWSRF); and

 

WHEREAS, on June 10, 2009, and as amended, the Clean Water Commission adopted the Final Clean Water State Revolving Fund’s Intended Use Plan which included Clean Water State Revolving Loan Funds for various wastewater projects, including the N.E. 52nd Street and Randolph Road Project; and

 

WHEREAS, on December 3, 2009, City Council approved Ordinance No. 090968 authorizing the issuance of SRF Sewer Revenue Bonds and appropriating the funds to the 2009 SRF Sewer Revenue Bond Fund; and

 

WHEREAS, $98,390.33 from the 2009 SRF Sewer Revenue Bond Fund needs to be appropriated to the N.E. 52nd Street and Randolph Road Project; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Water Services is hereby authorized to execute, on behalf of the City, an $89,445.75 contract with Kincaid Construction, Inc. for construction of Contract No. 967, Project No. 89003730, Sanitary Sewer Improvement – N.E. 52nd Street and Randolph Road. A copy of the contract is on file in the office of the Director of Water Services.

 

Section 2. That the Director of Water Services is authorized to expend the sum of $98,390.33 from funds previously appropriated in Account No. AL-8184-807170-B-89003730, Infill Sewers, including contingencies, to satisfy the cost of this contract.

Section 3. That upon completion of this contract, the Director of Finance is hereby authorized to return the unexpended portion of this appropriation to the Unappropriated Fund Balance from which it was derived.

Section 4. That the special assessments for 50% of total construction cost of the sewer extension plus 25% of the total construction cost of the sewer extension for engineering and administration less the amount approved for Project No. 89003730 from the Public Improvements Sales Tax Fund are hereby authorized to be made and levied upon the benefited properties within Sewer District No. 13050 according to the provision of Article II, Division II, Section 60-44, Rules for apportioning assessments, and Section 60-45, Cost of district sewers and how apportioned, all in Chapter 60, Code of Ordinances of the City of Kansas City, Missouri, relating thereto. Special tax bills evidencing the amount of such assessments shall be issued to Kansas City and shall be made payable in fifteen annual installments and, when collected, the proceeds thereof shall be credited to the Sewer Special Assessment Fund. The said special assessments shall bear interest at a rate per annum equal to the rate of ten year United States Treasury Notes as established at the last auction before the assessment is certified to the Director of Finance. If delinquent, said special assessments shall bear interest at a rate per annum two percent higher than the interest rate on assessments which are not delinquent.

Section 5. That this ordinance is recognized as an emergency measure within the provisions of Section 503 of the City Charter in that it relates to the construction of a public improvement, and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
