ORDINANCE NO. 971683

 

Authorizing construction of water mains in the area of 56th Street to 59th Street, Noland Road to Logan Road, Jackson County, to be paid through special assessments; approving a $287,787.87 construction contract therefor; authorizing expenditure of funds in the amount of $383,800.00; authorizing the execution of two Pipeline Crossing Agreements with Union Pacific Railroad Company; and recognizing an emergency.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY :

 

Section 1. That the construction of approximately 9,400 linear feet of 8-inch water main and appurtenances, in the area of 56th to 59th Street, Noland Road and Logan Road, is hereby approved and confirmed.

 

Section 2. That the work shall be done in accordance with the terms of a $287,787.87 contract between Kansas City, through its Director of Water Services, and Garney Companies Inc., which contract is on file in the office of the Director of Water Services.

 

Section 3. That the Director of Water Services is hereby authorized to expend up to the sum of $383,800.00 previously appropriated to the following account to satisfy the cost of this contract including contingency, engineering services and administrative costs:

Costs will be applied to said contract as follows:

Section 4. That special assessments are hereby authorized to be made and levied upon the lands benefited by and chargeable with said special assessment portion of the improvement, the costs of said water main and appurtenances to be apportioned in accordance with the front foot rule, all


in accordance with Chapter 78, Article IV of the Code of Ordinances. The benefit district is described as follows:

 

All that part of the Southeast Quarter of Section 35, Township 49, Range 32 (SE 35-49-32) and Southwest One Quarter Section 36, Township 49, Range 32 (SW 35-49-32) described as follows: Beginning at the northerly (NLY) line of 56th Street, as now established, and the easterly (ELY) right of way line of Missouri Pacific Railroad, thence NLY along said ELY right of way line to a point 441.5 feet north of NLY line 56th Street, thence ELY 670 feet, M/L, thence north 218 feet, more or less (M/L), thence east 3,950 feet M/L, thence southerly 1300 feet, M/L, thence ELY 1320 feet M/L, thence SLY 1320 feet to south line said Section 36, thence westerly (WLY) along south line said sections 36 and 35 to its intersection with ELY line of Noland Road, as now established, thence NLY along said ELY line Noland Road to a point 470 feet, M/L, north of south line said section 35, thence ELY to the intersection of the WLY line of Lot 3 Maloney Farm, and the ELY line of Missouri Pacific Railroad, thence NLY along said ELY line to north line of said Lot 3, thence ELY along said line to NE corner said lot and west line of Lot 2 Maloney Farm, thence NLY along said west line to NW corner said Lot 2, thence WLY from said NW corner to ELY right of way line of Missouri Pacific Railroad, thence NLY along said ELY right of way line to beginning; except that part lying south of 59th Street; AND

All that part of Northeast Quarter Section 2, Township 48, Range 32 (NE 2-48-32) described as follows:

Beginning at the intersection of said NE 2-48-32 and the ELY right of way line of Noland Road, thence ELY along the NLY line said NE 2-48-32 to its intersection with WLY line of Logan Road, thence SLY along said WLY line to SLY line Lot 6 Maloney Farm, thence WLY along SLY line to ELY line of Missouri Pacific Railroad, thence NLY along ELY line to NLY line NE 2-48-32, thence WLY along said NLY line to WLY line Missouri Pacific Railroad, thence SLY along said WLY line 733.4 feet M/L, thence WLY 75.82 feet, thence WLY 135.63 feet, thence NLY 320.58 feet, thence WLY 300.5 feet, thence NLY 409 feet, thence WLY 359.3 feet to ELY line Noland Road; thence NLY along said WLY line to beginning.

 

Special tax bills evidencing the amounts of such assessments shall be issued to Kansas City and shall be credited to the Water Operating Fund, and when collected the proceeds thereof shall be returned to and become a part of said fund. Special tax bills shall be made payable in twenty (20) annual installments at such time and with such effect as is provided in Article VIII of the Charter of Kansas City. Said special assessments shall bear interest at the rate of six percent (6%) per annum when not delinquent and seven percent (7%) per anum when delinquent.

 

Section 5. That the Director of Water Services is hereby authorized to execute, on behalf of Kansas City, two Railroad Pipeline Crossing Agreements with Union Pacific Railroad Company, such agreements to authorize crossing of the Union Pacific Railroad Company right-of-way at two locations for construction of the above referenced special assessment water main, and described as follows:

 

Railroad Mile Posts 267.57 and 268.20, Sedalia Subdivision, in Kansas City, Jackson County, Missouri.

 

Section 6. That because this improvement is to be paid for by special assessment, the ordinance is recognized to be an emergency measure within the provisions of Article II Section 15 of the Charter and shall take effect immediately upon passage.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
