ORDINANCE NO. 951369

 

Approving an amendment to a previously approved preliminary plan in District CP-2 on a 5 acre tract of land generally located at the northeast corner of 103rd Street and Wornall Road. (5772-CP-6)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-2 on a 5 acre tract of land generally located at the northeast corner of 103rd Street and Wornall Road; and more specifically described as follows:

 

All of the west 963.45 feet of the west half of the Northwest Quarter of Section 32, Township 48, Range 33, lying south of Indian Creek Greenway, in Kansas City, Jackson County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with the Subdivision Regulations and that the plat provide a cross-access easement to Wolfe's

Addition over the current drive into the existing Waid's restaurant facility.

 

2. That the developer contribute to the I-435/103rd Street Corridor Improvement Fund at the rate of $13.00 per gross square foot of store with credit for the existing facility

in the amount of $5,625.00.

 

3. That the developer submit a storm drainage study for review and approval by the City Engineer's Office.

 

4. That the developer submit site grading plans and plans for erosion and siltation control.

 

5. That the developer secure a permit from the Missouri Highway and Transportation Department for any work within State right-of-way.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 951369, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
