ORDINANCE NO. 090374

 

Repealing Section 1 of Committee Substitute for Ordinance No. 090320 and enacting a new Section 1 to correct the account number used to fund the land purchase for the new Police South Patrol Station; and recognizing an emergency.

 

WHEREAS, Committee Substitute for Ordinance No. 090320, passed April 30, 2009, authorized execution of documents and taking all steps necessary to purchase property from Purcell Oxford Investments LLC for the new Police South Patrol Station; and

 

WHEREAS, the account number in Committee Substitute for Ordinance No. 090320 contained a clerical error; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Section 1 of Committee Substitute for Ordinance No. 090320 is hereby repealed and the following section is enacted, to read as follows:

 

Section 1. That the Director of General Services is authorized to execute documents and take all steps necessary to effectuate the purchase of the Property from Purcell Oxford Investments LLC for an amount not to exceed $2,262,811.00 from funds previously appropriated to Account No. 09-2320-078026-E.

 

Section 2. That all other sections of Committee Substitute for Ordinance No. 090320 not repealed and reenacted above shall remain effective.

 

Section 3. That this ordinance, relating to the design, repair, maintenance of construction of public improvement, is recognized as an emergency measure within the provisions of Section 503 of the City Charter and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
