Approving a Community Unit Project on an
approximately 148.19 acre tract of land generally located on the east side of
N. Eastern Avenue (proposed), approximately 2600 feet south of N.E. 108th
Street. (12122-CUP)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That a Community Unit
Project on an approximately 148.19 acre tract of land generally located on the
east side of N. Eastern Avenue (proposed), approximately 2600 feet south of
N.E. 108th Street, and more specifically described as follows:
A tract of land in the
Northwest Quarter of Section 34, Township 52, Range 32, Kansas City, Clay
County, Missouri, being bounded and described as follows: Beginning at the southwest
corner of said Northwest Quarter; thence North 025'34" East, along the
west line of said Northwest Quarter, 408.09 feet; thence northerly, along a
curve to the right, tangent to the last described course, having a radius of
1100.00 feet, an arc distance of 538.99 feet; thence North 2830'03" East,
211.54 feet; thence northerly, along a curve to the left, tangent to the last
described course, having a radius of 980.00 feet, an arc distance of 787.17
feet; thence North 1731'17" West, 770.76 feet to a point on the north
line of said Northwest Quarter; thence South 8930'00" East, along the
north line of said Northwest Quarter, 2566.66 feet to the northeast corner of
said Northwest Quarter; thence South 006'43" West, along the east line of
said Northwest Quarter, 2618.44 feet to the southeast corner of said Northwest
Quarter; thence North 8917'43" West, along the south line of said
Northwest Quarter, 2640.16 feet to the point of beginning. Containing 148.19
acres, more or less.
is hereby approved, subject to the following
conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval when the first final plat is submitted and
that the developer make any necessary improvements as required by the City
Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer dedicate right of way for N. Eastern Avenue as required by the
Department of Public Works so as to provide 40 feet of right of way as measured
from the centerline of N. Eastern Avenue.
5. That
the developer improve the east half of N. Eastern Avenue to secondary arterial
street standards as required by the Department of Public Works and further
construct N. Eastern Avenue to N.E. 108th Street, if not yet constructed, as
required by the Department of Public Works.
6.
That the developer install hard surface roads and provide for fire
protection as required by the Fire Department prior to construction beyond
foundations.
7. That
the developer extend water mains as required by the Water Services Department.
8.
That the developer secure a land disturbance permit from the Missouri
Department of Natural Resources.
9. That
the developer submit a street tree planting plan as part of the final plat and
secure the approval of the City Forester for street trees planted on City right
of way, with a copy to be submitted to the Department of City Development. The
plan shall include, size, type, species and placement of trees.
10. That
the developer submit a street name sign plan to the Street Naming Committee for
approval.
11. That
the developer construct temporary cul-de-sacs as required by the Department of
Public Works.
12. That
the developer submit covenants, conditions and restrictions to the Law
Department for approval with the final plat for the maintenance of the private
open space and detention/retention areas.
13.
That the developer submit a final plan to the City Plan Commission for
approval, including plans for landscaping, screening, grading, berming and
signage.
A copy of said Community Unit Project plan is on
file in the office of the City Clerk under Document No. 990160, which is
attached hereto and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed Community Unit
Project hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
