ORDINANCE NO. 971576

 

Approving an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on an approximately 37.8 acre tract of land generally located at the southwest corner of N.W. 64th Street and Interstate I-29 for the purpose of deleting an approximately 4.8 acre tract of land from said development plan. (7588-CP-28)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District CP-2 (Local Planned Business Center) on an approximately 37.8 acre tract of land generally located at the southwest corner of N.W. 64th Street and Interstate I-29, and more specifically described as follows:

 

All of Lots 1, 2 and 3, Tremont Square West; all of Lots 1, 2, 3, 4, 5, 6, 7, 8 and Tract A, Tremont Square East; and all of Lots 3 and 4, Tremont Square, all being subdivisions lying in Kansas City, Platte County, Missouri.

 

for the purpose of deleting therefrom an approximately 4.8 acre tract of land, more specifically described as follows:

 

All of Lot 4, Tremont Square, a subdivision lying in Kansas City, Platte County, Missouri.

 

so that the remaining tract of land of approximately 33 acres, more specifically described as follows:

 

All of Lots 1, 2 and 3, Tremont Square West; all of Lots 1, 2, 3, 4, 5, 6, 7, 8 and Tract A, Tremont Square East; and Lot 3, Tremont Square, all being subdivisions in Kansas City, Platte County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be replatted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations, as determined necessary by the

City Engineer's Office.

 

2. That the developer submit a revised storm drainage study to the City Engineer's Office for approval and that the developer make any necessary improvements as

required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer secure the approval of the Missouri Highway and Transportation Department prior to working in any State right of way.

 

6. That the developer extend water mains as required by the Water Services Department.

 

7. That the developer extend sanitary sewers as required by the Department of Public Works.

 

8. That the developer provide for fire protection as required by the Fire Department.

 

9. That the developer submit a revised traffic study for the entire development (including office and retail) prior to any development in Phase I or Phase III as shown

on the preliminary plan to the Department of Public Works and to the Missouri

Highway and Transportation Department for approval.

 

10. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, signage (including elevations), and

building elevations.

 

A copy of said amended preliminary plan is on file in the office of the City Clerk under Document No. 971576, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
