ORDINANCE NO. 021503

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0453, rezoning an area of approximately 130 acres generally bounded by Missouri Route 152 on the north, N.W. Barry Road on the south, the prolongation of a line approximately 125 feet east of N. Winan Avenue on the east, and the prolongation of a line approximately 120 feet west of N. Winfield Avenue on the west, from Districts GP-6 (Low Density Residential Uses) and GP-7 (Agricultural and Low Density Residential Uses) to District GP-6 (Low Density Residential Uses), and approving a development plan for the same. (11029-GP-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0453, rezoning an area of approximately 130 acres generally bounded by Missouri Route 152 on the north, N.W. Barry Road on the south, the prolongation of a line approximately 125 feet east of N. Winan Avenue on the east, and the prolongation of a line approximately 120 feet west of N. Winfield Avenue on the west, from Districts GP-6 (Low Density Residential Uses) and GP-7 (Agricultural and Low Density Residential Uses) to District GP-6 (Low Density Residential Uses), said section to read as follows:

 

Section 80-11A0453. That an area legally described as:

 

All that part of the Northeast Quarter of Section 10, Township 51, Range 34, Kansas City, Platte County, Missouri, being more particularly described as follows: Commencing at the northwest corner of said Northeast Quarter; thence south along the west line of said Northeast Quarter to the south right of way line of Missouri Highway No. 152, as now established; thence easterly along said north right of way line to the northeast corner of Wildwood West - Third Plat, according to the recorded plat thereof; thence southerly, along the east lines of Wildwood West - Third Plat, Wildwood West - Second Plat and Wildwood West - First Plat, according to the recorded plat thereof, to the north right of way line of N.W. Barry Road, as now established; thence westerly along said north right of way line to the east line of a tract of land conveyed by Document No. 14598 to Daisy Bell and James Francis Bell, as shown in the deed records of Platte County, Missouri; thence northerly along the east line of said conveyed tract to the north line thereof; thence westerly along the north line of said conveyed tract to the west line thereof; thence southerly along the west line of said conveyed tract to the north right of way line of N.W. Barry Road, as now established; thence west along said north right of way line to the west line of said Northeast Quarter; thence north along the west line of said Northeast Quarter to the point of beginning.

 

is hereby rezoned from Districts GP-6 (Low Density Residential Uses) and GP-7 (Agricultural and


Low Density Residential Uses) to District GP-6 (Low Density Residential Uses), all as shown outlined on a map marked Section 80-11A0395, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

7. That the developer extend sanitary sewers as required by the Department of Public Works.

 

8. That the developer extend water mains and provide easements as required by the Water Services Department.

 

9. That the developer dedicate an additional 10 feet right of way for N.W. Barry Road as required by the Department of Public Works so as to provide a total of 50 feet of right of way as measured from the centerline of N.W. Barry Road.

 

10. That the developer widen N.W. Barry Road by six feet on each side of the road so as to provide an eastbound left-turn lane with adequate tapers at N. Arcola Avenue as required by the Department of Public Works.

 

11. That the developer provide adequate sight distance for N.W. Barry Road at proposed N. Arcola Avenue as required by the Department of Public Works.

 

12. That the developer construct temporary cul-de-sacs as required by the Department of Public Works.

 

13. That the developer contribute $25,687.77 in lieu of parkland dedication for 90 residential units (90 x 3.7 x 0.006 x $12,856.74) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

14. That the developer contribute a total of $3,666.00 for recreational purposes to the City with the platting of Wildwood West, Seventh Phase.

 

15. That the developer submit a street name signage plan for the entire development to the Street Naming Committee for approval prior to submittal of the first final plat.

 

16. That the developer submit covenants, conditions and restrictions to the Law Department for approval.

 

17. That the developer grant the city a noise and aviation easement.

 

 

18. That the developer enter into a Fair Disclosure Agreement to provide disclosure at the time of any real estate transaction.

 

19. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

20. That the developer submit a final plan for all proposed detention basins to the City Plan Commission for approval, including plans for landscaping, grading and storm drainage capacity.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 021503, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
