ORDINANCE NO. 971647

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0111, rezoning an area of approximately 6 acres generally located at the northeast corner of N.E. Antioch Road and N.E. 50th Street from District CP-2 (Local Planned Business Center) to District C-2-p (Local Retail Business - Limited District), and approving a preliminary plan for the same. (5642-CP-12)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0111, rezoning an area of approximately 6 acres generally located at the northeast corner of N.E. Antioch Road and N.E. 50th Street from District CP-2 (Local Planned Business Center) to District C-2-p (Local Retail Business - Limited District), said section to read as follows:

 

Section 80-11A0111. That an area legally described as:

 

TRACT A: A tract of land being a part of Lots 28, 29, 30, 55, and 56 and that portion of vacated Russell Avenue, all in Beulmar Acres, a subdivision of land in Kansas City, Clay County, Missouri, described as follows: Commencing at the northwest corner of said Lot 55; thence South 2343'04" West on the western line of said Lot 55, a distance of 55.00 feet to the point of beginning of the tract of land to be described; thence South 5402'45" East, a distance of 215.11 feet to the centerline of vacated Russell Avenue; thence North 1344'19" East on said centerline, a distance of 32.10 feet to an angle point therein; thence North 4969'20" East continuing on said centerline, a distance of 108.33 feet to an intersection with the northerly prolongation of a line drawn from the southwest corner of said Lot 30 to a point on the northerly line of said Lot 30, which is 15.40 feet east of the northwest corner thereof; thence South 355'55" West on said line a distance of 491.78 feet; thence North 8406'45" West on a line parallel to the south line of Lot 27, Beulmar Acres, a distance of 349.43 feet to a point on the easterly right of way line of Antioch Road, as established and recorded in Book 902 at page 613 in the recorder of deeds office, Clay County, Missouri; thence North 332'42" East continuing on said right of way, a distance of 239.03 feet to a point on the westerly line of said Lot 55; thence North 2343'08" East on said westerly line a distance of 242.25 feet to the point of beginning. Contains 3.29 acres, more or less. Subject to any and all easements, restrictions, rights of way of record in addition to those shown.

 

TRACT B: A tract of land being a part of Lots 27, 28, 29, 30, 31 and 32, all in Beulmar Acres, a subdivision of land in Kansas City, Clay County, Missouri, described as follows: Beginning at the intersection of the northerly right of way line of N.E. 50th Street and the easterly right of way line of Antioch Road, as established and recorded in Book 902, at page 613 in the recorder of deeds office, Clay County, Missouri;


thence North 058'26" East on said easterly right of way line of Antioch Road, a distance of 220.00 feet; thence South 8406'45" East parallel to the south line of said Lot 27, a distance of 346.31 feet to an intersection with a line drawn from the southwest corner of said Lot 30 to a point on the northerly line of said Lot 30, which is 15.40 feet east of the northwest corner thereof; thence South 8406'31" East, a distance of 300.94 feet to a point on the southeasterly line of said Lot 32 which is 20.34 feet northeasterly of the southwest corner of said Lot 32; thence South 3838'00" West on the southeasterly line of Lots 32 and 31, a distance of 96.84 feet; thence continuing on the southeasterly line of said Lots 31 and 30 on a curve to the right, tangent to the last described course, having a radius of 300.00 feet and an arc distance of 299.78 feet; thence North 8406'45" West on the south line of said Lot 27, a distance of 323.70 feet to the point of beginning. Contains 2.76 acres, more or less. Subject to any and all easements, restrictions, rights of way of record in addition to those shown.

 

is hereby rezoned from District CP-2 (Local Planned Business Center) to District C-2-p (Local Retail Business - Limited District), all as shown outlined on a map marked Section 80-11A0111, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved. A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 971647, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
