ORDINANCE NO. 980683

 

Approving an amendment to a previously approved development plan in District URD (Urban Redevelopment District) on approximately a 1.7 acre tract of land generally located at the southeast corner of 9th Street and Locust Street. (11901-URD-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District URD (Urban Redevelopment District) on approximately a 1.7 acre tract of land generally located at the southeast corner of 9th Street and Locust Street, and more specifically described as follows:

 

Lots 7 and 8, Block 4, Smarts Subdivision also known as Smarts Second Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof;

 

Lots 4, 5 and 6, Block 4, Smarts Subdivision also known as Smarts Second Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof;

 

The north 12 feet of Lot 26, all of Lots 27 and 28, Block 15, Smarts Addition No. 3, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof; and

 

Lots 29, 30, 31 and 32, Block 15, Smarts Addition No. 3, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer dedicate additional right of way for 9th Street as required by the Department of Public Works so as to provide 25 feet of right of way as measured from the centerline of 9th Street.


6. That the developer construct sidewalks on the south side of 9th Street and on the east side of Locust Street as required by the Department of Public Works in accordance with the Civic Mall Master Plan.

 

7. That the developer comply with the Kansas City Downtown Airport Height Zoning restrictions and that this language be included on the final plat as required by the Department of Public Works.

 

8. That the developer relocate fire hydrants as required by the Fire Department.

 

9. That the developer provide for fire protection as required by the Fire Department.

 

10. That the developer submit a site plan to the Director of the Department of City Development for approval prior to the approval of a building permit. The site plan shall include: development plan information; property uses; setback distances; lighting; landscaping; streetscaping; signage (including elevations); and architectural characteristics.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 980683, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
