Approving a Community Unit Project on a tract of land of approximately 29.9 acres generally located at N.E. Chowning and N.E. New Mark Drive. (5406-CUP-12)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on a tract of land of approximately 29.9 acres generally located at N.E. Chowning and N.E. New Mark Drive, and more specifically described as follows:

 

All that part of Tract AP-2 NEW MARK, a subdivision of land in Kansas City, Clay County, Missouri, and all that part of Sections 35 and 36, Township 52, Range 33, Kansas City, Clay County, Missouri all being described as follows: Commencing at the most southerly corner of Lot 45, WILLOW WOODS FIRST PLAT, a subdivision of land in Kansas City, Clay County, Missouri; thence westerly along the northerly right of way line of N.E. New Mark Drive along a curve to the right having an initial tangent bearing of South 67 47'54" West and a radius of 841.47 feet, an arc distance of 460.72 feet to the point of beginning of the tract of land herein to be described; thence continuing along said right of way along a curve to the right, having an initial tangent bearing of North 80 49'51" West and a radius of 841.47 feet an arc distance of 939.94 feet; thence continuing along said right of way North 16 49'51" West, a distance of 240.00 feet; thence continuing along said right of way along a curve to the left, being tangent to the last described course and having a radius of 899.44 feet, an arc distance of 858.13 feet to the southerly right of way line of N.E. Chowning Drive; thence northeasterly along the southerly right of way line of said N.E. Chowning Drive along a curve to the right, having an initial tangent bearing of North 18 30'18" East and a radius of 1233.09 feet (1243.24 feet platted), an arc distance of 724.53 feet (724.99 feet platted) to the most westerly corner of Tract "D", FOX HILL FOURTH PLAT, a subdivision of land in Kansas City, Clay County, Missouri, thence South 34 19'06" East along the southwesterly line of said Tract "D", a distance of 560.00 feet; thence continuing along the southwesterly line of said Tract "D", South 49 03'30" East, a distance of 352.91 feet; thence South 41 57'20" East, a distance of 550.15 feet; thence South 06 03'12" East, a distance of 718.39 feet; thence South 51 16'48" West, a distance of 219.18 feet to the point of beginning. Said tract contains 28.96 acres more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer install water mains as required by the Water Services Department.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval at the time the first final plat is submitted and that

the developer make any necessary improvements.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer construct sidewalks along N.E. Chowning Drive and N.E. New Mark Drive.

 

7. That the developer receive the approval of the Street Naming Committee for all street names.

 

8. That the developer dedicate 1.93 acres of parkland for 87 single family lots prior to recording the first plat in satisfaction of Section 66-128 of the Subdivision

Regulations.

 

9. That the developer submit a street tree planting plan as part of the final plat and secure the approval of the City Forester for street trees planted on right of way in

front of residential lots; with a copy of the plan to be submitted to the Department of

City Development.

 

10. That the developer construct all-weather roads and install fire hydrants prior to construction beyond footings and foundations.

 

11. That the developer submit a final plan to the Director of City Development and the City Plan Commission for approval, including a landscaping plan.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 951123, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
