COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 961427

 

Approving the assignment of certain development rights with respect to Phase 2 by Bedrock Redevelopment Corporation to K.C. Homestead Village Redevelopment Corporation; releasing Bedrock Redevelopment Corporation as it relates to those certain development rights; approving the first amendment to the development plan submitted by the Bedrock Redevelopment Corporation and K.C. Homestead Village Redevelopment Corporation and authorizing the Director of Finance to enter into a First Amendment to the Contract.

 

WHEREAS, the Bedrock Redevelopment Corporation, an urban redevelopment corporation of Missouri, organized under and pursuant to the Urban Redevelopment Corporations Act of 1945, as amended, did on November 13, 1995, file with the City Clerk an application for approval of a development plan which was approved by the City Council by Ordinance No. 951707, passed on January 18, 1996; and

 

WHEREAS, the Director of Finance was authorized to execute a contract pursuant to the development plan approval, hereinafter referred to as "Contract"; and

 

WHEREAS, said contract provides that no assignment of the rights and obligations contained therein could be made releasing Bedrock without the approval of the City; and

 

WHEREAS, Bedrock now desires to assign and transfer certain development rights to K.C. Homestead Village Redevelopment Corporation; and

 

WHEREAS, Bedrock Redevelopment Corporation and K.C. Homestead Village Redevelopment Corporation have filed a first amendment to the development plan with the City Clerk; and

 

WHEREAS, legal notice for a public hearing on the proposed first amendment to the development plan was published on August 19, 1996; and

 

WHEREAS, pursuant to said legal notice, a public hearing was held by the City Plan Commission on October 15, 1996; and

 

WHEREAS, the City Plan Commission has made an independent study and investigation of the proposed first amendment to the development plan and did recommend approval of the proposed first amendment to the development plan as it relates to Phase I but did recommend denial of the first amendment to the development plan as it relates to Phase II and did recommend denial of tax abatement for Phase II and said City Plan Commission has filed with the City Clerk a report recommending approval of same, said report being attached hereto as Exhibit "A"; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the assignment by Bedrock Redevelopment Corporation to K.C. Homestead Village Redevelopment Corporation of all its rights, title, obligations and interest with respect to Phase 2 and affects certain property legally described as:

 

Tract 2, Plaza Inn, a subdivision lying in Kansas City, Jackson County, Missouri.

 

is hereby approved. A copy of said assignment and release is attached hereto and incorporated herein by reference.

 

Section 2. That Bedrock Redevelopment Corporation is hereby released and discharged of its rights and obligations with respect to Phase 2 for the property legally described above in Section 1, accruing after the effective date of this ordinance. Bedrock Redevelopment Corporation is not released from any liability for actions accruing prior to the effective date of this ordinance.

 

Section 3. That the application of the Bedrock Redevelopment Corporation and K.C. Homestead Village Redevelopment Corporation for approval of a first amendment to the development plan, including all exhibits incorporated herein and filed with the City Clerk, is approved as the first amendment to the development plan as originally approved by Ordinance No. 951707, passed January 18, 1996. A copy of said application and exhibits are on file in the office of the City Clerk under Document No. 961427, and are incorporated herein by reference.

 

Section 4. That the Council finds and declares that good cause has been shown for the approval of said first amendment to the development plan of Bedrock Redevelopment Corporation and K.C. Homestead Village Redevelopment Corporation and that the findings and declarations made by the Council in Section 2 of Ordinance No. 951707, with respect to the development plan of Bedrock Redevelopment Corporation, have not been effected by the amendments thereto and equally apply to said development plan.

 

Section 5. That the Council finds and determines that the public convenience and necessity will be served by the amended development plan.

 

Section 6. That the Director of Finance be, and she is hereby, authorized and directed on behalf of the City to enter into a first amendment to the contract with the Bedrock Redevelopment Corporation and K.C. Homestead Village Redevelopment Corporation, a copy of which, in substantial form, is attached hereto as Exhibit "B", and which is incorporated herein by reference.
