ORDINANCE NO. 060807
Approving the 2nd Modification to
the 33rd and Montgall Urban Renewal Plan to add approximately 2.2 acres in an
area generally located on the south side of 34th Street between Prospect Avenue
and Montgall Avenue. (361-S-2)
WHEREAS, by
Ordinance Nos. 36285, 36287 and 39874, the Council approved the Oak Park Urban
Renewal Plan; and
WHEREAS, by
passage of Ordinance No. 61221, passed September 3, 1987, the City Council approved a general urban renewal plan for the 33rd and Montgall Urban Renewal
Project, which was a part of the Oak Park Urban Renewal Area; and
WHEREAS, it is
desirable and in the public interest that the 33rd and Montgall Urban Renewal
Plan be modified to allow development of elderly housing; and
WHEREAS, a copy
of the amendment has been filed with the City Clerk; and
WHEREAS, the
Land Clearance for Redevelopment Authority of Kansas City, Missouri, did on June 28, 2006, adopt Resolution No. 6-03-06 recommending approval of the 2nd Modification to the 33rd and Montgall Area to expand the boundaries to include an
additional 2.2 acres which allows for development of elderly housing; and
WHEREAS,
the City Plan Commission reviewed and recommended approval of the 2nd
Modification to the 33rd and Montgall Urban Renewal Plan, said recommendation
of the City Plan Commission being set forth on Exhibit A attached hereto and
incorporated herein by reference; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the 2nd Modification to the 33rd and Montgall Urban Renewal Plan which expands
the boundaries to include an additional 2.2 acres and which allows for
development of elderly housing is hereby approved. A copy of the 2nd
Modification to the 33rd and Montgall Urban Renewal Plan is on file with the
office of the City Clerk and is incorporated herein by reference.
Section B. That
the Council has duly made the findings necessary for compliance with Sections
99.320 and 99.430, Revised Statutes of Missouri, as amended.
Section C. That
it is hereby found and determined that all of the findings, determinations and
conclusions made and set forth in the previous ordinances listed above apply
with equal force and effect as of the date of this revision.
Section D. That
said Urban Renewal Plan and amendments are hereby found to be feasible and in
conformance with the Master Plan for the development of the community as a
whole.
