ORDINANCE NO. 050473
Authorizing the City Attorney to
file a Satisfaction of Judgment in the lawsuit styled City of Kansas City, Missouri v. Bethel AME Church, Case No. 99CV204308 in Jackson County Circuit Court.
WHEREAS, the
Bethel African Methodist Episcopal Church has applied to the U.S. Department of
Housing and Urban Development for federal subsidies to construct senior citizen
housing on a parcel of land located at 23rd & Vine Streets; and
WHEREAS, one of
the last remaining impediments to HUDs approval of the federal subsidy needed
to construct this senior citizen housing at this location is an unsatisfied
judgment taken against the Bethel AME Church in favor of the City for the
Citys costs of demolishing a structure that had been declared a dangerous
building that was situated on the tract of land with the address 2304 Vine; and
WHEREAS, the
current balance due on this unsatisfied judgment is $10,329.77; and
WHEREAS, the Bethel AME Church does not have the necessary funds to fully pay the current balance; but,
is willing to pay an additional $500.00 towards that balance; NOW, THEREFORE,
BE IT ORDANIED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the City Attorney is hereby authorized to file a Satisfaction of Judgment in
the lawsuit styled City of Kansas City, Missouri v. Bethel AME Church, Case No. 99CV204308 in Jackson County Circuit Court upon the receipt of payment of
$500.00.
