ORDINANCE NO. 951371

 

Accepting various easements and deeds in Jackson, Clay and Platte Counties; releasing various easements Jackson and Clay Counties; and directing the City Clerk to record the acceptance.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That various easements in Kansas City, Jackson County, executed by the following persons, and which appear of record as the instrument numbers and respective books and pages as follows:

Section 6. All that part of a 10 foot wide standard sewer easement recorded in the office of the Recorder of Deeds for Clay County, Missouri, at Liberty, as document no. E31219 in book 1443 at page 594, being more particularly described as follows: Commencing at the southeast corner of Lot 11, Block 7, Lakeside Heights, a subdivision of land in the City of Kansas City, Clay County, Missouri; thence north along the east line of said Lot 11, a distance of 11.46 feet; thence north 90 degrees 00 minutes 00 seconds west, a distance of 10.58 feet to the point of beginning of the tract of land herein to be described; thence north 90 degrees 00 minutes 00 seconds west, a distance of 10.00 feet; thence north 00 degrees 16 minutes 07 seconds west, a distance of 97.90 feet to the northeasterly line of said Lot 11, thence south 35 degrees 38 minutes 01 seconds east along the northeasterly line of said Lot ll, a distance of 17.28 feet; thence south 00 degrees 16 minutes 07 seconds east, a distance of 83.85 feet to the point of beginning, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 7. The 15 foot utility easement dedicated by the plat of Attic Space West, a subdivision in Kansas City, Jackson County, Missouri, centered on the north line of Lot 1, Attic Space West, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 8. That the 15 foot utility easement dedicated by the plat of Attic Space West, a subdivision in Kansas City, Jackson County, Missouri, centered on the north line of Lot 2, Attic Space West, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 9. That a part of an easement by and between Kansas City, Missouri and Brookshire L.L.C. and Westridge L.L.C. legally described as follows: all that part of Sections 15 and 22 of Township 51, Range 33, in Kansas City, Clay County, Missouri, more particularly described as follows: Commencing at the Northeast Corner of Lot 40 of the West Gate Meadows, a subdivision of land in Kansas City, Clay County, Missouri, as shown on the recorded plat thereof; thence South 89 degrees, 29 minutes, 50 seconds East along the Easterly extension of the North Line of said Lot 40; 7.00 feet, thence North 0 degrees, 26 minutes, 40 seconds East 66.63 feet; thence Northerly along a curve to the left from the last-described course as a tangent, having a radius of 396.00 feet, an arc distance of 123.39 feet; thence continuing Northerly, and Northeasterly, along a curve to the right, having a common tangent with the last-described curve to the last-described point, having a radius of 425.07 feet, an arc distance of 379.79 feet; thence North 33 degrees, 46 minutes, 59 seconds East tangent to the last described curve 134.20 feet; thence Northeasterly and Easterly along a curve to the right from the last-described course as a tangent, having a radius of 668.00 feet, an arc distance of 521.71 feet; to the TRUE POINT OF BEGINNING, and also referred to as Point "A", of the Easement Area to be released, which is a ten (10) foot strip of land, being five (5) feet on each side of, and adjoining, the described line; thence continuing along the same curve to the right from the last-described course as a tangent, having a radius of 218.00 feet, an arc distance of 88.04 feet; thence North 13 degrees, 12 minutes, 55 seconds East tangent to the last-described curve at the last-described point, 358.16 feet; thence North 7 degrees, 17 minutes, 01 seconds West, 147.00 feet; thence North 13 degrees, 12 minutes, 55 seconds East, 14630 feet, to a point on the Southerly line of NW Hidden Lakes Drive, formerly known as NW Reiger Road, as now established. Last said point being 18.49 feet West from reference ground coordinate North 1114209.316 East 473032.754, measured along said Southerly Line as shown on the recorded plat of Hidden Lakes, Lots 45 thru 92; be and the same are hereby released to its present owners, their heirs and assigns, and the Director of Water Services, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 10. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the offices of the Recorder of Deeds for Jackson County, Missouri, at Kansas City and Independence, for Clay County, Missouri, at Liberty, and for Platte County, Missouri, at Platte City, respectively.
