ORDINANCE NO. 011762

 

Approving a Community Unit Project on an approximately 107.66 acre tract of land generally located on the north side of N.E. 96th Street and on the west side of N.E. Cookingham Drive. (11771-CUP-6)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 107.66 acre tract of land generally located on the north side of N.E. 96th Street and on the west side of N.E. Cookingham Drive, and more specifically described as follows:

 

Part of the Southwest Quarter and the Southeast Quarter of Section 35, Township 52, Range 32 and the Northwest Quarter of Section 2, Township 51, Range 32, all in Kansas City, Clay County, Missouri, being more particularly described as follows: Commencing at the northwest corner of said Southwest Quarter; thence South 89E30'12" East along the north line of said Southwest Quarter, a distance of 1310.83 feet to the northwest corner of the East Half of said Southwest Quarter, said point also being the true point of beginning of the herein described tract; thence continuing South 89E30'12" East along said north line a distance of 1162.33 feet to a point 148.50 feet west of the northeast corner of said Southwest Quarter; thence South 00E42'23" West and parallel to the east line of said Southwest Quarter, a distance of 181.50 feet to a point; thence South 89E30'12" East and parallel to said north line, a distance of 148.50 feet to a point on said east line; thence South 89E31'07" East and parallel to the north line of said Southeast Quarter, a distance of 337.70 feet to a point on the southwesterly right of way line of Missouri Highway 291, as now established; thence South 23E00'48" East along said southwesterly right of way line, a distance of 594.90 feet to a point of curvature; thence continuing along said southwesterly right fo way line and along a cure to the left having a radius of 1185.92 feet, a central angle of 31E19'20" and a length of 648.31 feet to a point on the northwesterly line of Montclair - First Plat, a subdivision of land in Kansas City, Clay County, Missouri; thence South 35E39'53" West along said northwesterly line, a distance of 70.00 feet to a point; thence South 59E32'05" East continuing along said northwesterly line, a distance of 50.00 feet to a point; thence South 30E27'55" West continuing along said northwesterly line a distance of 488.78 feet to a point of curvature; thence continuing along said northwesterly line and along a curve to the right having a radius of 1650.00 feet, a central angle of 51E51'43" and a length of 1493.52 feet to a point; thence South 07E40'23" East continuing along said northwesterly line, a distance of 100.00 feet to a point of curvature; thence along a curve to the right having a radius of 1750.00 feet, a central angle of 11E37'46", an initial tangent bearing of South 82E19'37" West, and a length of 355.20 feet to a point; thence North 00E26'36" East, a distance of 50.10 feet to a point of curvature; thence along a curve to the right having a radius of 1700.00 feet, a central angle of 11E39'08", an initial tangent bearing of North 85E56'24" West, and a length of 345.73 feet to a point; thence North 74E17'16" West, a distance of 184.49 feet to a point on the west line of the East Half


of said Southwest Quarter; thence North 00E36'54" East along said west line, a distance of 2496.71 feet to the true point of beginning, and containing 107.6550 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval when the first plat is submitted and that the developer construct any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer dedicate additional right of way for N.E. 96th Street as required by the Department of Public Works so as to provide a total of 50 feet of right of way as measured from the centerline of N.E. 96th Street.

 

7. That the developer improve the north half of N.E. 96th Street to primary arterial street standards as required by the Department of Public Works.

 

8. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

9. That the developer extend water mains as required by the Water Services Department.

 

10. That the developer extend sanitary sewers as required by the Department of Public Works.

 

11. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of


the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

12. That the developer receive the approval of the Board of Zoning Adjustment for any neighborhood identification signs prior to the issuance of a sign permit.

 

13. That the developer construct temporary cul-de-sacs for each phase as required by the Department of Public Works.

 

14. That the developer submit covenants, conditions and restrictions with the final plat to the Law Department for approval for the maintenance of private open space.

 

15. That the developer petition for the vacation of right of way of N. Flintlock Road and N.E. 98th Street as required by the Department of Public Works.

 

16. That the developer dedicate right of way and construct a public turnaround at the termination of N. Flintlock Road as shown on the Community Unit Project plan as required by the Department of Public Works.

 

17. That the developer submit a final plan for the private open space to the City Plan Commission for approval, including plans for grading and landscaping.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 011762, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
