COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 130021

 

Authorizing the City Manager to execute a Redevelopment Contract with Land Clearance Redevelopment Authority and Hospital Hill Economic Development Corporation for development of a grocery store at 27th Street and Troost Avenue within the Beacon Hill Development Project Area.

 

WHEREAS, the Beacon Hill Development Project Area is generally located within the area bounded by 22nd Street on the north, Troost Avenue on the west, 27th Street on the south and Vine Street on the east and is situated within a community whose residents’ health and medical care needs are served by Truman Medical Center’s Hospital Hill hospital and clinics; and

 

WHEREAS, the Beacon Hill Development Project Area is situated within a “food desert” and, as such, is a community whose residents do not have ready access to a grocery store providing a selection of healthy, nutritional food choices; and

 

WHEREAS, the current patient population served by Truman Medical Center’s Hospital Hill hospital and clinics includes a significant number of persons suffering from diabetes, hypertension, coronary disease, obesity and other chronic health conditions that can be treated by improved nutrition and a future patient population for whom these same chronic diseases can be prevented or treated by improved nutrition; and

 

WHEREAS, the availability of healthy, nutritional food choices for this patient population should reduce the future need for, and the related costs of, providing medical care to those persons; and

 

WHEREAS, Truman Medical Center has proposed the development of a grocery store in the southwestern corner of the Beacon Hill Development Project Area at the corner of 27th Street and Troost Avenue through its economic development subsidiary, the Hospital Hill Economic Development Corporation (“HHEDC”), to provide the preventative and treating care afforded by healthy, nutritional food choices and needed by the patient population it serves; and

 

WHEREAS, on April 28, 2011, the City Council passed Second Committee Substitute for Ordinance No. 110300, authorizing the City Manager to enter into a contract with the Economic Development Corporation of Kansas City, Missouri, the Land Clearance for Redevelopment Authority of Kansas City, Missouri (“LCRA”), the Economic Development Corporation Charitable Fund and the EDC Loan Corporation for the management of assets to be transferred from the Housing and Economic Development Financial Corporation (“HEDFC”) and the City, in part, for the continued development of the Beacon Hill project; and

 

WHEREAS, on October 11, 2012, the U.S. District Court for the Western District of Missouri issued an Order in the receivership action styled City of Kansas City, Missouri v. Housing and Economic Development Financial Corporation, Case No. 05-00368-CV-W-GAF, authorizing the Receiver to enter into a Real Estate Sale Contract with HHEDC that required that it assemble the entire tract of land needed for the proposed grocery store on or before December 31, 2012; and

 

WHEREAS, on October 11, 2012, the City Council passed Ordinance No. 120880 which authorized the conveyance of then existing City-owned parcels within the Beacon Hill Development Project Area to LCRA, among which were parcels needed to assemble the entire tract of land needed for the proposed grocery store; and

 

WHEREAS, on November 8, 2012, the City Council passed Ordinance No. 120963 which authorized the condemnation or negotiated acquisition of the then privately-owned parcels within the Beacon Hill Development Project Area needed to assemble the entire tract of land for the proposed grocery store; and

 

WHEREAS, on December 13, 2012, the City Council passed Ordinance No. 121057 which authorized the conveyance of the parcels acquired pursuant to the above Ordinance No. 120963 within the Beacon Hill Development Project Area to LCRA, among which were parcels needed to assemble the entire tract of land needed for the proposed grocery store; and

 

WHEREAS, the Redevelopment Contract provides for the conveyance of the City-owned parcels to the HHEDC on or before February 28, 2013; and

 

 WHEREAS, the remainder of the property needed for the proposed grocery store has been assembled and is owned by the HEDFC; and

 

WHEREAS, the HEDFC has entered into an agreement with the HHEDC to convey the remaining property to the HHEDC on or before February 28, 2013, subject to specified contingencies; and

 

WHEREAS, the terms of the Redevelopment Contract addressing the development of a grocery store at the above site have been negotiated as between the HHEDC, the LCRA and the City; and

 

WHEREAS, the Boards of both the HHEDC and the LCRA have both authorized the execution of the Redevelopment Contract; NOW, THEREFORE;

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 


Section 1. That the City Manager is authorized to execute a redevelopment contract with Hospital Hill Economic Development Corporation and the Land Clearance for Redevelopment Authority for the development of a grocery store within the Beacon Hill Development Project Area at the corner of 27th Street and Troost Avenue in substantial form to that Redevelopment Contract attached hereto. A copy of the Redevelopment Contract, in substantial form, is on file in the City Attorney’s Office.
