COMMITTEE SUBSTITUTE FOR
ORDINANCE NO. 980722
Approving an amendment to a previously approved
preliminary plan in District CP-2 (Local Planned Business Center) on
approximately a 5 acre tract of land generally located at the southeast corner
of 103rd Street and State Line Road. (5656-CP-10)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That an amendment to a
previously approved preliminary plan in District CP-2 (Local Planned Business
Center) on approximately a 5 acre tract of land generally located at the
southeast corner of 103rd Street and State Line Road, and more specifically
described as follows:
All of Blocks 1, 2, and
3, Watts Mill Shopping Center, a subdivision in Kansas City, Jackson County,
Missouri.
is hereby approved, subject to the following
conditions:
1. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
2. That
the developer contribute a total of $2,340.00 to the I-435/103rd Street
Corridor Improvement Fund based upon a rate of $1.80 square feet for the 1,300
square foot restaurant addition as required by the Department of Public Works
prior to the issuance of a certificate of occupancy.
3. That
the developer construct sidewalks on the south side of 103rd Street as required
by the Department of Public Works prior to the issuance of a certificate of
occupancy.
4. That
the developer provide for fire protection as required by the Fire Department.
5. That
the developer submit a final plan to the City Plan Commission for approval,
including plans for landscaping and signage.
6. That
the developer consider dedication of land or provision of an easement for the
Indian Creek Greenway bike trail.
A copy of said amendment is on file in the
office of the City Clerk under Document No. 980722, which is attached hereto
and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed amendment hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
