ORDINANCE NO. 060280

 

Approving the preliminary plat of Blue River Woods on a 38 acre tract of land generally located on the south side of Blue Ridge Boulevard at Blue River Road. (SD 1085A)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat Blue River Woods on a 38 acre tract of land generally located on the south side of Blue Ridge Boulevard at Blue River Road, and more specifically described as follows:

 

The East of the Northeast of the Southwest Quarter and the West one half of the Northwest Quarter of the Southeast Quarter of Section 16, Township 47, Range 33, in Kansas City, Jackson County, Missouri, except that part in roads and except that part lying North of Blue Ridge Extension and Blue Ridge Boulevard, being further described as follows: Beginning at the Southwest corner of the Northwest Quarter of the Southeast Quarter of Section 16-47-33 said Point of Beginning also being the Southeast corner of the Northeast Quarter of the Southwest Quarter of said Section 16-47-33; thence North 87 degrees 31 minutes 17 seconds West, along the south line of said Northeast Quarter of the Southwest Quarter, 663.78 feet; thence North 03 degrees 25 minutes 39 seconds East, 1050.61 feet, to a point on the southerly right of way line of Blue Ridge Boulevard; thence Northeasterly along said southerly right of way line, along a non tangent curve to the right, having a radius of 1095.92 feet, a chord bearing of North 73 degrees 58 minutes 02 seconds East, a chord length of 684.63 feet and an arc length of 696.28 feet, to a point of tangency; thence South 87 degrees 49 minutes 55 seconds East, tangent to the last described curve, along the south right of way line of Blue Ridge Extension, 686.88 feet, to the northwest corner of Lot 10, BLUE RIDGE FARMS, a subdivision of land in Kansas City, Jackson County, Missouri; thence South 03 degrees 37 minutes 51 seconds West, along the west line of BLUE RIDGE FARMS, 1269.43 feet, to a point on the south line of said Northwest of the Southeast of Section 16-47-33; thence North 87 degrees 43 minutes 35 seconds West, along said south line of the Northwest of the Southeast , 664.18 feet, to the Point of Beginning. Contains 1,641,888.8 square feet or 37.69 acres. Less that part taken or used for road right of way. Subject to any and all easements, restrictions and covenants recorded or unrecorded.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit a macro overall storm drainage study for the entire development for approval at the time the first plat is submitted, submit a micro detailed storm drainage study and construct any necessary improvements as required.

 

3. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

4. That the developer submit plans for grading and siltation and erosion control for approval prior to beginning any construction activities.

 

5. That the developer secure a land disturbance permit prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

6. That the developer extend sanitary sewers and/or storm sewers to ensure individual service is provided to all proposed lots and determine adequacy as required.

 

7. That the developer extend water mains and grant easements as required by the Water Services Department.

 

8. That the developer dedicate an additional 6 feet of right-of-way for Blue Ridge Boulevard along the full length of the sites northern property line as required.

 

9. That the developer improve the north half of E. 129th Street to collector street standards as required.

 

10. That the developer construct all new streets and cul-de-sacs as shown on the preliminary plat.

 

11. That the developer submit covenants, conditions and restrictions to the Law Department for approval and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

12. That the developer contribute $25,269.10 in lieu of parkland dedication for 89 single-family units (89 x 3.7 x 0.006 x $12,789.30) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

13. That the developer secure the approval of the Street Naming Committee for all street names prior to the submittal of the first final plat.

 

14. That the developer secure the approval of the Board of Zoning Adjustment for any proposed subdivision identification signs prior to requesting a sign permit.

 

15. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right-of-way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

16. That the Council grants a variance to the 3:1 lot dimension ratio in the Subdivision Regulations for all proposed lots not in conformity with the required ratio.

 

17. That the developer construct the deceleration/acceleration lanes on Blue Ridge Boulevard at proposed Woodland Avenue and as shown on the preliminary plat as required.

 

18. That the developer submit a final plan for all tracts to the City Plan Commission for approval, including detailed information on landscaping, grading, and signage (including elevations).

 

19. That the developer construct the westbound left turn lane on Blue Ridge Boulevard at Woodland Avenue as shown on the preliminary plat as required.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
