ORDINANCE NO. 040056

 

Approving the preliminary plat of the Metropolitan Condominiums on an approximately 2.57 acre tract of land generally located at the northwest and southeast corners of Admiral Boulevard and Cherry Street. (SD 1078)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of the Metropolitan Condominiums on an approximately 2.57 acre tract of land generally located at the northwest and southeast corners of Admiral Boulevard and Cherry Street, and more specifically described as follows:

 

CONDOMINIUM PROPERTY:

 

All of Lots 1 thru 5, inclusive, a portion of Lot 19, and all of Lots 20 thru 24, inclusive, Block 6, Rices Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, and that part of the vacated alley lying in said Block 6, and the west 4 feet of vacated Holmes Street lying east of and adjacent to said portion of Lot 19 and to said Lots 20 thru 24, inclusive, all of which is more particularly described as follows: Beginning at the intersection of the south line of Admiral Boulevard, as said Boulevard is now established, with the east line of Cherry Street as said street is now established: thence South 0 degrees 15 minutes East, along the east line of said Cherry Street, a distance of 250 feet, to its intersection with the north line of 8th Street as said street is now established; thence North 90 degrees East, along the north line of said 8th Street, a distance of 292 feet, to a point 4 feet east of the east line of said Lot 24; thence North 0 degrees 15 minutes West, a distance of 260 feet, to a point on the south line of said Admiral Boulevard, 4 feet east of the east line of said Lot 19; thence North 90 degrees West, along the south line of said Admiral Boulevard, a distance of 136 feet; thence South 0 degrees 15 minutes East, a distance of 10 feet; thence North 90 degrees West, along the south line of said Admiral Boulevard, a distance of 156 feet, to the point of beginning.

 

CONDOMINIUM OFFSITE PARKING:

 

Lots 13 thru 17, both inclusive, Block 7, Rices Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 


2. That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri Licensed Civil Engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to the City Engineers Office prior to approval and issuance of any building permits, and that the developer construct any improvements as required by the City Engineer's Office.

 

3. That the developer secure permits to reconstruct or construct sidewalks, including curb, gutters, and catch basins along all project frontage as required by the Department of Public Works prior to recording of the plat.

 

4. That the developer submit the condominium declarations, covenants and restrictions to the Law Department for approval.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 040056, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
