ORDINANCE NO. 180957

 

Authorizing the Director of Water Services to execute a $500,000.00 Feasibility Cost Share Agreement (FCSA) between the Department of the Army (the “Government”) and the City of Kansas City, Missouri, (the “Non-Federal Sponsor”) for the Lower Brush Creek Ecosystem Restoration Feasibility Study; and authorizing expenditure of $250,000.00 for the City’s portion of the Agreement.

WHEREAS, Section 1135 of the Water Resources Development Act of 1986, as amended, authorizes the Government to review the need for modifications of existing projects for the purpose of providing measures to improve environmental quality and ecosystem restoration in the Brush Creek corridor from the Paseo Boulevard Bridge to the confluence with the Blue River in Kansas City, Missouri; and

WHEREAS, Section 105(a) of the Water Resources Development Act of 1986, Public Law 99-662, as amended (33 U.S.C. 2215(a)), specifies the cost-sharing requirements; and

WHEREAS, the Government and the Non-Federal Sponsor have the full authority and capability to perform in accordance with the terms of this Agreement; NOW THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

  Section 1. That the Director of Water Services is hereby authorized to enter into and execute, on behalf of the City, a $500,000.00 cost-sharing agreement with the Department of the Army for the Lower Brush Creek Ecosystem Restoration Feasibility Study, Project No. 82000288. A copy of the agreement is on file in the office of the Director of Water Services.  

Section 2. That the Director of the Water Services Department is authorized to expend up to $250,000.00, from Account No. AL-3619-808053-B-82000288, Brush Creek – Lake of Enshriners, to satisfy the City’s portion of this agreement.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
