Approving an amendment to a previously approved
preliminary plan in District C-3a1-p (Intermediate Business, Low Buildings -
Limited District) on an approximately 9.93 acre tract of land generally located
on the east side of Booth Avenue at 67th Terrace for the purpose of deleting an
approximately 0.81 acre tract of land from said preliminary plan. (5072-P-7)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved preliminary plan in District C-3a1-p (Intermediate Business, Low
Buildings - Limited District) on an approximately 9.93 acre tract of land
generally located on the east side of Booth Avenue at 67th Terrace, and more
specifically described as follows:
All that part of the North 1/2 of the Northeast 1/4
of Section 7, Township 48, Range 32, partly in Raytown and partly in
Kansas City and entirely in Jackson County, Missouri, described as
follows: Beginning at a point 50.0 feet north and 315.0 feet west of the
southeast corner of said 1/2 1/4 section; thence due west along a line
50.0 feet north of and parallel with the south line of said 1/2 1/4
section a distance of 184.86 feet; thence due north a distance of 299.42
feet; thence northwesterly along a curve to the left, with the last
described course as a tangent, and having a radius of 100.0 feet an arc
distance of 104.72 feet; thence North 60 00'00" West 539.70 feet;
thence northwesterly along a curve to the left with the last described course
as a tangent and having a radius of 180.0 feet an arc distance of 94.25
feet; thence due west 322.61 feet; thence due north 555.25 feet, to the
south line of 67th Street, as now established; thence South 89 58'10"
East, along last said line, a distance of 245.28 feet, to the intersection
of said south line of 67th Street with the southwesterly line of U.S.
Highway No. 50, as now established; thence southeasterly along said
highway line and along a curve to the right having an initial tangent bearing
of South 85 07'49" East and having a radius of 1402.70 feet, an arc
distance of 911.02 feet; thence South 25 23'55" East along said
highway line a distance of 175.93 feet; thence southeasterly along said
highway line and along a curve to the left with the last described course
as a tangent and having a radius of 974.93 feet, an arc distance of 199.08
feet; thence South 37 05'55" East along said highway line a distance of
66.29 feet; thence South 81 05'42" West a distance of 173.42 feet;
thence South 0 10'00" East a distance of 470.00 feet to the point of
beginning, except that part conveyed by Warranty Deed I-398328 in Book I-961
at page 829, described as follows: Beginning at the intersection of the
easterly right of way line of Booth Avenue and the southerly right of way
line of 67th Street as both are now established; thence easterly along the
southerly right of way line of said 67th Street, 200 feet; thence southerly
parallel with the easterly right of way line of said Booth Avenue, 300
feet; thence westerly and parallel with the southerly right of way line of
said 67th Street, 200 feet to the easterly right of way line of said Booth
Avenue; thence northerly along said easterly right of way line, 300 feet
to the point of beginning.
for the purpose of deleting therefrom an approximately
0.81 acre tract of land, more specifically described as follows:

the north line of said Northeast Quarter a distance of 1,422.21 feet;
thence South 02 21'29" West a distance of 40.13 feet to a point at
the intersection of the south right of way line of 67th Street and the east
right of way line of Booth Avenue; thence continuing South 02 21'29"
West along said east right of way line a distance of 360.11 feet to the
point of beginning of the tract of land to be described; thence South 86
48'31" East a distance of 194.23 feet; thence South 02 21'29"
West a distance of 192.34 feet; thence North 87 38'31" West a distance
of 194.21 feet to a point on said east right of way line; thence North 02
21'29" East along said east right of way line a distance of 195.16

is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office for approval and that the
developer make any necessary improvements as required by the
City Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
4. That the developer dedicate additional right of
way for 67th Terrace as required by the Department of Public Works so
as to provide 60 feet of right of way for 67th
Terrace.
5. That the developer improve 67th Terrace to
collector street standards as required by the Department of Public
Works.
6. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
7. That the developer extend water mains as
required by the Water Services Department.
8. That the developer provide for fire protection
as required by the Fire Department.
9. That the developer construct temporary
cul-de-sacs as required by the Department of Public Works.
10. That the developer secure the approval of the
Missouri Highway and Transportation Department prior to working in
any State right of way.
11. That the developer submit a final plan to the
City Plan Commission for approval, including plans for landscaping.
A copy of said amendment is on file in the office of the
City Clerk under Document No. 970819, which is attached hereto and made a part
hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
