ORDINANCE NO. 090388

 

Amending Ordinance No. 060984 passed September 14, 2006, which authorized the City Manager to enter into a contract with Ace Pipe Cleaning, Inc. for $1,288,324.21 for sanitary sewer extension at 66th & Manchester, by enacting a new Section 6 which authorizes assessments on Sewer District Nos. 11024 through 11030, and 11048, and repealing Ordinance No. 070833 in its entirety.

 

WHEREAS, due to a clerical error, Ordinance No. 060984 did not authorize assessments on Sewer District Nos. 11024 through 11030, and 11048; and

 

WHEREAS, Ordinance No. 070833 passed August 16, 2007 is being repealed in its entirety as it did not include wording allowing for further reduction of the assessment amounts to benefited properties in the 66th and Manchester project area; and

 

  WHEREAS, the Public Improvements Advisory Committee and Ordinance No. 090180 passed March 26, 2009 approved for the fifth district project 66th and Manchester for Year 26 (2009-10) additional funds to further reduce the assessments; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Ordinance No. 060984 passed September 14, 2006, which authorized the City Manager to enter into a contract with Ace Pipe Cleaning, Inc. is hereby amended by enacting a new Section 6 authorizing the assessment against the benefited properties in Sewer District Nos. 11024 through 11030, and 11048, to read as follows:

 

Section 6. That the special assessments for 50% of total construction cost of the sewer extension plus 25% of the total construction cost of the sewer extension for engineering and administration less PIAC approved funding are hereby authorized to be made and levied upon the benefited properties within Sewer District Nos. 11024 through 11030, and 11048 according to the provision of Article II, Division II, Section 60-44. Rules for apportioning assessments, Section 60-45, Cost of district sewers, how apportioned, and Section 60-46, Cost of joint district sewers; how apportioned, all in Chapter 60, Code of Ordinances of Kansas City, relating thereto. Special tax bills evidencing the amount of such assessments shall be issued to Kansas City and shall be made payable in fifteen annual installments and, when collected, the proceeds thereof shall be credited to the Sewer Special Assessment Fund. The said special assessments shall bear interest at a rate per annum equal to the rate of ten year United States Treasury Notes as established at the last auction before the assessment is certified to the Director of Finance. If delinquent, said special assessments shall bear interest at a rate per annum two percent higher than the interest rate on assessments which are not delinquent. All in accordance with Section 1305 of the Charter of Kansas City.

 

Section 2. That all sections of Ordinance No. 060984 not repealed and reenacted above shall remain effective.

 

Section 3. That Ordinance No. 070833 passed August 16, 2007, is hereby repealed in its entirety.
