ORDINANCE NO. 990334

 

Accepting various easements and deeds in Jackson, Clay and Platte Counties; releasing various easements in Clay County; and directing the City Clerk to record the acceptance.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That various easements and deeds in Kansas City, Jackson County, executed by the following persons, and which appear of record as the instrument numbers and respective books and pages as follows:

 

1. Temporary Easement from Michael A. Fuller, Instrument No. I86475, Book I3302, Page 2369;

 

2. Temporary Easement from Timothy A. Otto, Instrument No. I86476, Book I3302, Page 2371;

 

3. Storm Drainage Easement from Land Trust, Instrument No. I86477, Book I3302, Page 2373;

 

4. General Warranty Deed from Irvin E. and Diane M. Youngberg, Instrument No. I86478, Book I3302, Page 2376;

all recorded in the office of the Recorder of Deeds for Jackson County, Missouri, at Independence, are hereby accepted.

Section 3. That various easements in Kansas City, Platte County, executed by the following persons, and which appear of record as the instrument numbers and respective books and pages as follows:

 

1. Standard Sewer Easement from Tiffany Greens, Inc., Instrument No. 0002946, Book 900, Page 836;

 

2. Storm Drainage Easement from Tiffany Greens, Inc., Instrument No. 0002947, Book 900, Page 837;

 

3. Storm Drainage Easement from Tiffany Greens, Inc., Instrument No. 0002948, Book 900, Page 838;

 

4. Storm Drainage Easement from Tiffany Greens, Inc., Instrument No. 0002949, Book 900, Page 839;

all recorded in the office of the Recorder of Deeds for Platte County, Missouri, at Platte City, are hereby accepted.

 

Section 4. That the legal descriptions for such properties listed in Sections 1, 2 and 3 are set forth in Exhibit A, which is attached hereto and incorporated herein by reference.

 

Section 5. All of the 10.0 foot wide sewer easement dedicated by Document No. B45405, filed for record in the office of the Recorder of Deeds for Clay County, Missouri, in Book 720 at Page 170, lying across Lot 10, Block 2, Winnwood Beach, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 6. All that part of a 10.0 foot wide sewer easement dedicated by Document No. B45404, filed for record in the office of the Recorder of Deeds for Clay County, Missouri, in Book 720, at Page 169, lying across Lots 11 and 12, Block 2, Winnwood Beach, except the south 9.0 feet of Lot 12, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 7. All that part of a 15.00 foot sanitary sewer easement, as described in Book 2150 at Page 412 and in Book 2133 at Page 495, to be vacated, lying 7.50 feet on each side of the following described centerline: Commencing at the northwest corner of the southeast quarter of Section 26, Township 52, Range 33, Kansas City, Clay County, Missouri; thence south 89 degrees 31 minutes 14 seconds east, along the north line of the southeast quarter of said Section 26, a distance of 46.57 feet; thence south 01 degrees 33 minutes 40 seconds east, a distance of 230.66 feet; thence south 79 degrees 43 minutes 39 seconds east, a distance of 231.57 feet to the point of beginning of the centerline herein to be described; thence south 55 degrees 51 minutes 13 seconds east, a distance of 602.21 feet; thence south 77 degrees 02 minutes 30 seconds east, a distance of 220.41 feet to the point of termination, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successor or assigns, as further evidence thereof.

Section 8. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the offices of the Recorder of Deeds for Jackson County, Missouri, at Independence, for Clay County, Missouri, at Liberty, and for Platte County, Missouri, at Platte City.
