COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 961375

 

Approving an amendment to a previously approved development plan in District GP-3 (Regional Business) on approximately a 33 acre tract of land generally located at the southeast corner of N.W. Barry Road and Interstate 29. (6399-GP-15)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GP-3 (Regional Business) on approximately a 33 acre tract of land generally located at the southeast corner of N.W. Barry Road and Interstate 29, and more specifically described as follows:

 

Lots 1, 2, 3, and 4 of Barrywoods Crossing, a subdivision of land lying in Kansas City, Platte County, Missouri, and a tract of land being described as all of Lot 5, Barrywoods Crossing, a subdivision of land in Kansas City, Platte County, Missouri, and part of the Southwest Quarter of Section 7, Township 51 North, Range 33 West, Kansas City, Platte County, Missouri, more particularly described as follows: Commencing at the northeast corner of the Southwest Quarter of said Section 7; thence North 89 01'00" West, along the north line of said Southwest Quarter, a distance of 1166.97 feet; thence South 00 59'00" West along the northerly prolongation of the east line of Lot 1 of said Barrywoods Crossing, a subdivision of land in said city, county and state, a distance of 60.00 feet to a point on the south right of way line of N.W. Barry Road (Missouri Highway No. 152); thence continuing South 00 59'00" West, along the easterly line of Lot 1, of said Barrywoods Crossing, a distance of a distance of 216.23 feet; thence North 89 01'00" West, along said east line, a distance of 1.00 feet; thence South 00 59'00" West, along said east line, a distance of 61.77 feet, to the northeast corner of Lot 5, of said Barrywoods Crossing and to the point of beginning; thence continuing South 00 59'00" West, along the east line of Lot 5, of said Barrywoods Crossing, a distance of 252.99 feet; thence South 00 43'01" West, a distance of 214.75 feet; thence South 43 58'31" East, along said east line, a distance of 53.75 feet, to a point of curvature; thence southeasterly, along said east line and along a curve to the right having a radius of 321.00 feet and a central angle of 17 00'00", a distance of 95.24 feet to a point of tangency; thence South 26 58'31" East, along said east line, a distance of 22.70 feet, to a point of curvature; thence southeasterly, southerly and southwesterly, along said east line and along a curve to the right having a radius of 15.00 feet and a central angle of 88 38'37", a distance of 23.21 feet to a point of reverse curvature and to a point on the west right of way line of N.W. Barrybrooke Drive; thence southwesterly and southerly along said west right of way line and along a curve to the left having a radius of 550.00 feet and a central angle of 60 41'06", a distance of 582.53 feet, to a point of tangency; thence South 00 59'00" West, along said west right of way line, a distance of 162.06 feet; thence North 89 01'00" West, a distance of 880.62 feet, to a point on the east right of way line of Roanridge Road; thence North 08 50'00" East, along said east right of way line, a distance of 292.64 feet; thence North 11 43'15" East, along said east right of way line, a distance of 664.64 feet, to a point of curvature; thence northeasterly along said east right of way line and along a curve to the right having a radius of 270.00 feet and a central angle of 60 49'23", a distance of 286.62 feet, to a point of tangency; thence North 72 32'38" East, along said east right of way line, a distance of 126.76 feet, to a point of curvature; thence northeasterly along said east right of way line and along a curve to the left having a radius of 330.00 feet and a central angle of 15 24'28", a distance of 88.74 feet, to a point of curvature; thence northeasterly along said east right of way line and along a curve to the left having a radius of 390.00 feet, an initial tangent bearing of North 60 27'18" East, and a central angle of 24 30'06", a distance of 166.77 feet, to the northwest corner of Lot 5 of said Barrywoods Crossing; thence South 49 27'22" East, along the northerly line of Lot 5, of said Barrywoods Crossing, a distance of 119.86 feet; thence South 89 01'00" East, along said northerly line, a distance of 304.00 feet, to the point of beginning. Containing 25.40 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause Lot 5, Barrywoods Crossing, to be replatted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City,

Missouri, as amended, commonly known as the Subdivision Regulations, to include

the additional area as shown on the development plan.

 

2. That the developer extend water mains as required by the Water Services Department.

 

3. That the developer provide for fire protection as required by the Fire Department.

 

4. That the developer comply with the KCI Airport Height Zoning restrictions and that this language be included on the final plat.

 

5. That the developer grant a Noise and Aviation Easement to the City.

 

6. That the developer submit a landscape and architectural plan to the Director of the Department of City Development for approval which includes detailed information

on landscaping, lighting and architectural features. The landscape plan shall include

the construction of a berm by the developer along the N.W. Barrybrooke Drive

frontage which shall be 4 to 6 feet in height.

 

7. That the developer enter into an Agreement relating to Access to Barrybrooke Drive not to exceed the amount of $10,000.00 whereby the developer will initially construct

a gate across the entrance to the development from Barrybrooke Drive and the City

will complete a traffic study to determine the impact of an uninterrupted access to

Barrybrooke Drive.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 961375, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
