ORDINANCE NO. 100683
Authorizing a $26,065.00
agreement with George Butler Associates, Inc. for design professional services
for Project No. 89003406, N.E. 61st and N. Wheeling Avenue Sanitary Sewer
Extension; authorizing the Director of Water Services Department to expend
$26,065.00 previously appropriated funds for the project; and assessing the
properties benefited.
WHEREAS,
Ordinance No. 011467, passed November 1, 2001, authorized a $92,988.50 contract
with George Butler Associates, Inc. for design
professional services in connection with the sanitary sewer extension at N.E. 61st
and N. Wheeling Avenue, Project No. 89003406; and
WHEREAS,
Ordinance No. 041419, passed January 13, 2005, authorized a $41,344.40 first
amendment to the contract with George Butler
Associates, Inc. for design professional services in connection with the
sanitary sewer extension at N.E. 61st and N. Wheeling Avenue, Project No. 89003406;
and
WHEREAS, this
agreement provides for final design professional services for new gravity
sanitary joint district and collection systems to serve residential areas in
the vicinity of N.E. 61st and N. Wheeling Avenue; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the Director of Water Services Department is authorized to enter into and
execute, on behalf of the City, a $26,065.00 agreement
with George Butler Associates, Inc. for design
professional services in connection with sanitary sewer extension at N.E. 61st and
N. Wheeling Avenue, Project No. 89003406, in Kansas City, Clay County,
Missouri, Council District 1. A copy of the contract is on file in the office
of the Director of Water Services.
Section 2. That
the Director of Water Services Department is authorized to expend the sum of $26,065.00 from funds previously appropriated to
Account No. 11-3010-808081-B-89003406, Sanitary Sewer Program, for the design
professional services agreement.
Section 3. That
upon completion of the final costs of this contract, the Director of Finance is
authorized to return the unexpended portion of this appropriation to the
Unappropriated Fund Balance from which it was derived.
Section 4. That
when the sewer system designed under this agreement is built, the cost of this
design contract shall be included in the costs to be specially assessed against
the benefited properties as provided in Article VIII of the City Charter and
the proceeds from the assessment of that cost shall be returned to the Sewer
Special Assessment Fund.

I hereby certify
that there is a balance, otherwise unencumbered, to the credit of the
appropriation to which the foregoing expenditure is to be charged, and a cash
balance, otherwise unencumbered, in the treasury, to the credit of the fund
from which payment is to be made, each sufficient to meet the obligation hereby
incurred.
