COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 001345

 

Approving a Community Unit Project on an approximately 9.36 acre tract of land generally located approximately 1,000 feet north of N.E. Parvin Road on the west side of N. Bennington Road. (12010-CUP-6)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 9.36 acre tract of land generally located approximately 1,000 feet north of N.E. Parvin Road on the west side of N. Bennington Road, and more specifically described as follows:

 

A portion of the South 1/2 of the South 1/2 of the Southeast 1/4 of the Northwest 1/4 of Section 4, Township 50, Range 32, in Kansas City, Clay County, Missouri, described as follows: The west 1/4 of the above described tract and the north 300 feet of the east 3/4 of the above described tract, except any portion contained in roadways, streets and highways.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer construct any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

6. That the developer dedicate additional right of way for N. Bennington Road as required by the Department of Public Works so as to provide a total of 30 feet of right of way as measured from the centerline of N. Bennington Road.

 

7. That the developer improve one-half of N. Bennington Road to collector street standards as required by the Department of Public Works, including construction of curbs, gutter and sidewalks and installation of streetlights.

 

8. That the developer extend water mains as required by the Water Services Department.

 


9. That the developer provide for fire protection as required by the Fire Department.

 

10. That the developer contribute $11,073.10 in lieu of parkland dedication for 26 duplex units and 47 multi-family units in satisfaction of Section 66-128 of the Subdivision Regulations.

 

11. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

12. That the developer extend sanitary sewers as required by the Department of Public Works.

 

13. That the developer secure the approval of the Street Naming Committee for all street names prior to the submittal of the final plat.

 

14. That the developer receive a Certificate of Survey for a lot split approved by the Department of City Development prior to the sale of individual units.

 

15. That the developer insure that adequate site distance is provided at the proposed intersection with N. Bennington Road as required by the Department of Public Works.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 001345, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
