ORDINANCE NO. 180679
Authorizing a Lease with Hunt
Midwest Real Estate Development, Inc., at 8250 N.E. Underground Drive, Kansas
City, Missouri, as alternative space for the Kansas City Police Department
evidence facility; reducing an appropriation in the Contingent Appropriation
account of the General fund by $106,834.00; appropriating that amount of the
Police Facilities account; and recognizing this ordinance as having an
accelereated effective date.
WHEREAS, on
August 23, 2018, a fire occurred at 5300 Municipal Avenue that caused fire and
water damage to the building and its contents including the KCPD evidence room;
and
WHEREAS, to
minimize the property damage and to properly secure all KCPD evidence, the
City immediately began remediation efforts with SERVPRO on August 23, 2018,
and needs to relocate such evidence into another satisfactory leasehold space
so that the remediation efforts may continue with all deliberate speed; and
WHEREAS, to
immediately preserve property and evidence, and to minimize the possibility of
additional damage to property, the City needs to immediately enter into a
Lease to complete this remediation project and more adequately and safely
secure such evidence into the future at an alternative location; and
WHEREAS, Hunt
Midwest Real Estate Development, Inc. (“Landlord”) is willing to lease an
initial space of approximately 61,900 square feet, as needed for the
remediation, but reduce the number of square feet thereafter to approximately
30,000 square feet after six months, when the remediation is completed, for the
remainder of the eight year initial term; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section
1. That the Assistant to Director-Business and Support as the designee for the
Director of the Department of General Services (“Director”) is authorized to
further negotiate and execute a Lease with Hunt Midwest Real Estate
Development, Inc., for an eight year term effective immediately, at 8250 N.E.
Underground Drive, Kansas City, Missouri, as alternative space to replace for
the fire and water damaged evidence facility used by the Board of Police
Commissioners of Kansas City, Missouri at 5300 Municipal Avenue.
Section 2. That
the City Manager is authorized for the fiscal year commencing May 1, 2019, and
each fiscal year thereafter that the City remains a party to the Lease, to
allocate any costs under the Lease, from one or more of one or more sources,
including the City wide allocation within the Capital Improvements Program
administered by the Public Improvements Advisory Committee (“PIAC”); provided,
however, any such allocation shall be limited by eligibility due to regulations
applied to such funding sources.
Section 3.
That the appropriation in the following account in the General Fund is reduced
by the following amount:
19-1000-179990-B Contingent
Appropriation $106,834.00
Section 4. That the following
amount is appropriated from the Unappropriated Fund Balance of the General Fund
to the following account in the General Fund:
19-1000-071719-B Police
Facilities $106,834.00
Section 5. That
the Director is authorized to amend the Lease within the initial eight year
term without additional Council authorization provided that the aggregate
rental expenditure for such entire term does not exceed $635,746.00.
Section
6. That this ordinance is recognized as an ordinance with an accelerated
effective date as provided by Section 503(a)(3)(C) of the City Charter in that
it appropriates money, and shall take effect in accordance with that section.

I hereby certify that
there is a balance, otherwise unencumbered, to the credit of the appropriation
to which the foregoing expenditure is to be charged, and a cash balance,
otherwise unencumbered, in the treasury, to the credit of the fund from which
payment is to be made, each sufficient to meet the obligation hereby incurred.
