ORDINANCE NO. 980390
Assigning
portions of vacated 48th Street and Grand Avenue adjacent to Mill Creek Parkway
in Kansas City, Jackson County, Missouri, for public use for park purposes in
accordance with Section 58 of the Charter and directing the City Clerk to file
same.
WHEREAS,
the Council finds and determines that by Resolution No. 24191 adopted by the
Board of Parks and Recreation Commissioners on January 27, 1998, certain lands
were acquired for street right-of-way and Committee Substitute for Ordinance
No. 971177 vacated said street and the Board desires to use one-half of the
vacated right-of-way for Parks and Recreation purposes in Kansas City, Jackson
County, Missouri, and said Board has now recommended to the Council that the
assigned vacated right-of-way hereinafter described be accepted for public use
and for park purposes; NOW, THEREFORE,
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
1. That the following described vacated right-of-way be assigned for park
purposes in accordance with Article II, Section 58 of the Charter:
All that part of vacated Grand Avenue and vacated 48th
Street described as follows: Beginning at the southeast corner of Lot 11,
Block 3, New South Moreland Addition, a subdivision in the Northeast Quarter of
the Southwest Quarter of Section 29, Township 49 North, Range 33 West, Kansas
City, Jackson County, Missouri; thence South 236'20" West along the east
line of the said Block 3 a distance of 149.7 feet to the north line of vacated
48th Street; thence South 4733'14" East a distance of 85.02 feet to the
northwest corner of Lot 9, Block 4 of New South Moreland Addition; thence North
227'42" East along the northerly prolongation of the west line of said
Lot 9 a distance of 30.0 feet to the centerline of vacated 48th Street; thence
North 8733'18" West along the said centerline of 48th Street a distance
of 30.0 feet to the southerly prolongation of the centerline of vacated Grand
Avenue; thence North 236'20" East along the centerline of vacated Grand
Avenue and its southerly prolongation a distance of 179.73 feet to the easterly
prolongation of the south line of the said Lot 11; thence North 8723'40"
West along the said easterly prolongation of the south line of Lot 11 a
distance of 30.0 feet to the point of beginning. Containing 0.1238 acres, more
or less, subject to all easements and restrictions now on record.
Section
2. That the City Clerk is hereby directed to record a copy of this ordinance
in the office of the Director of Records for Jackson County, Missouri at Kansas
City as evidence of the assignment of the herein described property by the City
for public use purposes.
