ORDINANCE NO. 001565, AS AMENDED

 

Determining the advisability of the Garfield Avenue Sanitary Sewer Project, ordering the creation of a Neighborhood Improvement District generally located at or near the 12700 block of Garfield Avenue in the Blue Ridge Farms Addition, a subdivision in Kansas City, Jackson County, Missouri, for a special assessment improvement project for a sanitary sewer line extension, and authorizing the Director of Public Works to cause plans and specifications to be prepared for the project improvements.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Council hereby finds and determines that the Petition requesting the Garfield Avenue Sanitary Sewer Project is complete and proper in all respects.

 

Section 2. That the City Council hereby finds and determines that the Garfield Avenue Sanitary Sewer Project is advisable and a Neighborhood Improvement District (the District) is hereby created in Kansas City, to include the following real property:

 

Lots 7; 8; 9; 10; a part of Tract B on certificate of survey of Lots 5 and 11 filed as document K1162103 in Block S-4 p. 88 on 10-7-94; 12; 13; and 14, BLUE RIDGE FARMS ADDITION, a subdivision in Kansas City, Jackson County, Missouri.

 

Section 3. The name for the Project shall be the Garfield Avenue Sanitary Sewer Project.

 

Section 4. That the purpose of creating the District is to facilitate the construction of public improvements desired by the real property owners in the District, to define the property benefitted by and subject to special assessments for the costs of design and construction (the Project) of a proposed sanitary sewer line (the Improvements) beginning at or near the intersection of Blue Ridge Boulevard Extension and Garfield Avenue and extending south within the public right-of-way, to serve the properties at 12700, 12705, 12706, 12708, 12709, 12712 and 12715 Garfield Avenue and 2101 East Blue Ridge Boulevard Extension and to establish the method of assessment of real property in the District for the costs of the Improvements. The Project will include the replacement of driveway aprons that are damaged in the course of construction; restoration of sod by replacement or seeding; necessary adjustments to manholes affected by the Project and installation of service lines to the respective property lines of the aforementioned lots along both sides of Garfield Avenue. The estimated total cost (Estimated Cost) of the Project is Ninety-nine Thousand Two Hundred Dollars ($99,200.00).

 

Section 5. That the total cost of the Project (Total Cost) and method of payment for the Project shall be as follows:

 

The Total Cost of the Project shall include all City-related incurred expenses including design, project financing, administrative, construction, inspection, and contract administration for the completion of the Improvements. The costs to be assessed (Assessed Costs) to the property in the District shall be the difference


between the Total Costs of the Project, less General Fund Appropriations allocated to the Project. The Assessed Costs to be assessed to the real property in the District and the amount of general obligation bonds issued for the Project shall not, without a new petition meeting the requirements of Section 67.457 RSMo., exceed the Estimated Cost by more than twenty five (25%) percent.

 

The eight (8) lots or property parcels situated within the District will be assessed an equal one-eighth (1/8) share of the total costs to be assessed for the Improvements. The owner of each lot or parcel or their successors and assigns shall pay an equal one-eighth (1/8) share of the Assessed Costs to be assessed for the Improvements in a lump sum or the costs may be amortized and assessed yearly over a period of twenty (20) years. Amortized payments shall include interest on the unpaid balance of an assessed obligation at the rate of interest on the General Obligation Bonds issued to fund the Project.

 

Section 6. The Director of Public Works is authorized to cause plans and specifications to be prepared for the Improvements.
