ORDINANCE NO. 121021
Approving the plat of Colonnades at Beacon Hill, an addition in
Jackson County, Missouri; accepting and releasing various easements; vacating a
portion of a street; authorizing the Director of City Development to execute
and/or accept certain agreements; and authorizing the City Clerk to record this
ordinance and attached documents. (SD1167E)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the plat of Colonnades
at Beacon Hill, a subdivision in Jackson County, Missouri, a true and
correct copy of which is attached hereto and incorporated herein by reference,
is hereby approved.
Section 2. That the plat granting and reserving unto
Kansas City an easement and license or right to locate, construct, operate and
maintain facilities including, but not limited to, water, gas, sewerage,
telephone, cable TV, surface drainage, underground conduits, pad mounted
transformers, service pedestals, any and all of them upon, over, under and along
the strips of land outlined and designated on the plat by the words utility
easement or U/E be and the same are hereby accepted and where other easements
are outlined and designated on the plat for a particular purpose, be and the
same are hereby accepted for the purpose as therein set out.
Section 3. That all right, title and interest in the
following recorded easement be and the same is hereby released to the
respective owners, their successors or assigns, over that part of aforesaid
easement under the following, this release does not become effective
until the final plat is recorded:

Sewer Rights
|
Description for the release of
sewer rights in the vacated alley described below.
All that part of the
north south vacated alley, first east of Tracy Avenue, vacated by Ordinance No.
23095, recorded August 5, 1903, lying north of East 27th Street being more
particularly described as follows:
Commencing at the
southwest corner of Lot 11, Block 5, Porter Park, a subdivision in Kansas City,
Jackson County, Missouri according to the recorded plat thereof; thence South
87 degrees 26 minutes 06 seconds East along the south line of said Lot 11, a
distance of 150.02 feet (plat=150.00 feet) to the point of beginning of the
herein described tract, said point being on the west line of said vacated
alley; thence North 02 degrees 20 minutes 28 seconds East along said west line,
a distance of 105.22 feet; thence South 87 degrees 28 minutes 14 seconds East,
a distance of 15.00 feet to a point on the east line of said vacated alley;
thence South 02 degrees 20 minutes 28 seconds West along said east line, a
distance of 105.23 feet to the southwest corner of Lot 12, said Block 5; thence
North 87 degrees 26 minutes 06 seconds West, a distance of 15.00 feet to the
point of beginning.
Section 4. That the portion of Colonnade Drive which
is identified on the plat as right of way “to be vacated by this plat,” is
hereby vacated because the Council finds that no private rights will be
unreasonably injured or endangered by this vacation and that the public will
suffer no unreasonable loss or inconvenience thereby.
Section 5. That the Director of City Development is
hereby authorized to execute and/or accept any and all agreements necessary to
clear the title of any right of way, utility easements or other public property
dedicated on the plat.
Section 6. That the City Clerk is hereby directed to
record copies of this ordinance, together with the documents described herein
and all other relevant documents, when the plat has been released for
recording, in the Office of the Recorder of Deeds of Jackson County, Missouri.
Section 7. That the Council finds that the City Plan
Commission has duly endorsed its approval of this Ordinance hereon.
