ORDINANCE NO. 021464
Approving
the preliminary plat of Winterset, 1st Plat on an approximately 6 acre tract of
land generally located along E. 52nd Street (extended) between Hunter Avenue
and Elm Avenue. (SD 1009)
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That the preliminary plat of Winterset, 1st Plat on an approximately 6 acre
tract of land generally located along E. 52nd Street (extended) between Hunter
Avenue and Elm Avenue, and more specifically described as follows:
All that part of Lot 1, Hawkins Addition, and
Lot 20, Ellington Heights, subdivisions located in Kansas City, Jackson County,
Missouri, located in the Northwest 1/4 of Section 32, Township 49 North, Range
32 West, more particularly described as follows: Beginning at the northeast
corner of Lot 1, Hawkins Addition; thence South 00E31'08" East, a distance of 459.95
feet; thence South 89E47'16" West, a
distance of 123.40 feet; thence North 00E12'44"
West, a distance of 150.00 feet; thence South 89E47'16" West, a distance of 665.26 feet;
thence North 00E46'25" West, a
distance of 309.97 feet; thence North 89E49'51"
East, a distance of 789.29 feet to the point of beginning. The above described
tract of land contains 6.04 acres, more or less.

hereby approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with Chapter
66, Code of Ordinances of Kansas City, Missouri, as amended, commonly known as
the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer construct any improvements as required by the
City Engineer's Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities if the disturbed area exceeds one acre.
5. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
6. That
the developer extend water mains and provide easements as required by the Water
Services Department.
7. That
the developer construct hard surface roads and provide for fire protection as
required by the Fire Department prior to construction beyond foundations.
8. That
the developer construct sanitary sewers as required by the Department of Public
Works.
9. That
the developer construct E. 52nd Street to residential street standards with a total
right of way of 50 feet as required by the Department of Public Works,
including construction of curbs, gutters and sidewalks and installation of
streetlights.
10. That
the developer improve the north half of E. 52nd Terrace to residential street
standards as required by the Department of Public Works, including construction
of curbs, gutters and sidewalks and installation of streetlights.
11. That
the developer contribute $6,850.07 in lieu of parkland dedication for 24 single
family lots (24 x 3.7 x 0.006 x $12,856.74) in satisfaction of Section 66-128
of the Subdivision Regulations.
12. That
the developer submit a street tree planting plan as part of the final plat with
a copy to be submitted to the Department of City Development, secure the approval
of the City Forester for street trees planted on right of way in front of
residential lots, and plant the street trees in conformance with the plan
approved by the City Forester. The plan shall include size, type, species and
placement of trees.
13. That
the developer submit covenants, conditions and restrictions to the Law
Department for approval for maintenance of the detention tract prior to the
approval of the final plat.
A
copy of the preliminary plat is on file in the office of the City Clerk under
Document No. 021464, which is attached hereto and made a part hereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed preliminary plat hereinabove, all public notices have been given and
hearings have been held as required by the Subdivision Regulations.
