ORDINANCE NO. 990788

Accepting a Corporation Warranty Deed from Young Mens Christian Association of Greater Kansas City, conveying to the City certain property in Clay County, Missouri for public use as an addition to Gorman Park and directing the City Clerk to record the ordinance.

WHEREAS, the Council finds and determines that, by Resolution No. 24590 adopted by the Board of Parks and Recreation Commissioners on March 2, 1999, certain lands were acquired through purchase for public use for park purposes as an addition to Gorman Park in Kansas City, Clay County, Missouri, and said Board has now recommended to the Council that the deed hereinafter described be accepted for public use; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That pursuant to a certain Corporation Warranty Deed, recorded in the office of the Recorder of Deeds for Clay County, Missouri, at Liberty as Instrument No. P16339 in Book 2903, at page 177, the City Council hereby accepts said property for public use for park purposes in accordance with Article III, Section 58 of the Charter of Kansas City. The property is legally described as follows:

TRACT I: Part of the Northwest Quarter of the Northwest Quarter of Section 1, Township 50, Range 33, in Kansas City, Clay County, Missouri, beginning 433 feet east of the west line and 40 feet, more or less, south of the north line of said Quarter Quarter Section; said point being on the south line of right of way of Highway No. 69; thence south, parallel to the west line, 196 feet; thence west 10 feet to a creek; thence up said creek with the meanderings thereof, to the south line of said Highway No. 69; thence east 261 feet to the point of beginning.

TRACT II: A tract of land in the Northwest Quarter of Section 1, Township 50, Range 33, Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the northwest corner of said Northwest Quarter; thence North 8956'52" East, along the north line of said Northwest Quarter, 433.00 feet; thence south 007'07" West, parallel with the west line of said Northwest Quarter, 236.00 feet to the true point of beginning of the tract to be herein described; thence continuing South 007'07" West, 148.78 feet; thence North 3116'50" West, 136.40 feet; thence South 8959'07" West, 180.87 feet to a point on the easterly line of N.E. 47th Terrace, as now established; thence northerly along said easterly line, along a curve to the left, having an initial tangent bearing of North 159'33" East, a radius of 183.00 feet, an arc distance of 32.75 feet; thence North 815'37" West, along said easterly line, 197.07 feet to a point on the southerly right of way line of Highway No. 69, as now established; thence South 8955'45" East, along said southerly right of way line, 22.92 feet to the centerline of a creek, as now established; thence South 1230'07" East, along said centerline 149.02 feet; thence South 1107'21" East, along said centerline 67.48 feet; thence North 6634'06" East, along said centerline, 166.80

feet; thence South 4528'49" East, along said centerline, 71.32 feet, thence South 8952'53" East, 10.00 feet to the true point of beginning.

TRACT III: A tract of land in the Northwest Quarter of Section 1, Township 50, Range 33, Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the northwest corner of said Northwest Quarter; thence North 8956' East, along the north line of said Northwest Quarter, 433.00 feet; thence South 007' West, parallel with the west line of said Northwest Quarter, 384.78 feet to the true point of beginning of the tract to be herein described; thence South 3116'50" East, 121.43 feet; thence South 4834'09" West, 15.24 feet; thence North 3116'50" West, 269.62 feet; thence North 8959'07" East, 17.55 feet; thence South 3116'50" East, 136.40 feet to the true point of beginning. Subject to easements, restrictions, reservations and covenants, if any of record.

Section 2. That Resolution No. 24590 evidences the intent of the Board of Parks and Recreation Commissioners to accept such real property for park purposes.

Section 3. That the City Clerk is hereby directed to record a copy of this ordinance in the office of the Recorder of Deeds for Clay County, Missouri, as evidence of the acceptance of the herein described property by the City for public use purposes.
