ORDINANCE NO. 990159
Amending Chapter 80, Code of Ordinances, by
adding a new section to be known as Section 80-11A0194, rezoning an area of
approximately 460.27 acres generally located on the east and west sides of N.
Eastern Avenue (proposed), south of N.W. 108th Street, from District R-1aa
(One-Family Dwellings) to District R-1a (One-Family Dwellings). (10988-P-2)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That Chapter 80, Code of
Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the
Zoning Ordinance, is hereby amended by enacting a new section to be known as
Section 80-11A0194, rezoning an area of approximately 460.27 acres generally
located on the east and west sides of N. Eastern Avenue (proposed), south of
N.W. 108th Street, from District R-1aa (One-Family Dwellings) to District R-1a
(One-Family Dwellings), said section to read as follows:
Section 80-11A0194. That an area
legally described as:
A tract of land in the
South One-Half of Section 27, the East One-Half of the Southeast Quarter of
Section 28, the Northeast Quarter of Section 33, and the Northwest Quarter of
Section 34, all in Township 52, Range 32, Kansas City, Clay County, Missouri,
being bounded and described as follows: Beginning at the southeast corner of
the Northeast Quarter of said Section 33; thence North 8949'54" West,
along the south line of said Northeast Quarter, 2641.87 feet to the southwest
corner of said Northeast Quarter; thence North 023'33" East, along the
west line of said Northeast Quarter, 916.80 feet; thence South 8930'36"
East, 475.00 feet; thence North 6502'12" East, 936.53 feet to the
northeast corner of the Southwest Quarter of said Northeast Quarter; thence
North 024'34" East, along the west line of the Northeast Quarter of said
Northeast Quarter, 1311.89 feet to the northwest corner of the Northeast
Quarter of said Northeast Quarter; thence South 8911'19" East, along the
north line of said Northeast Quarter, 1321.73 feet to the northwest corner of said
Northwest Quarter; thence South 8930'00" East, along the north line of
said Northwest Quarter, 59.11 feet; thence North 1731'17" West, 1042.91
feet; thence northerly, along a curve to the right, tangent to the last
described course, having a radius of 1250.00 feet, an arc distance of 971.12
feet; thence North 2659'29" East, 7.71 feet; thence South 630031"
East, 198.05 feet; thence southeasterly, on a curve to the left, tangent to the
last described course, having a radius of 790.00 feet, an arc distance of
237.37 feet; thence South 8013'26" East, 93.16 feet; thence southeasterly
on a curve to the right, tangent of the last described course, having a radius
of 470.00 feet, an arc distance of 224.86 feet; thence South 5248'42"
East, 248.58 feet; thence North 4236'44" East, 141.95 feet; thence North
5322'05" East, 74.05 feet; thence North 3637'55" West, 72.16 feet;
thence North 2811'20" West, 96.77 feet; thence North 1417'34" West,
96.77 feet; thence North 0102'25" West, 72.01 feet; thence North 011'22"
East, 150.01 feet; thence North 1016'20" West, 116.67 feet; thence North

to a point on the north line of said Southwest Quarter; thence South

north line, 1950.86 feet
to the northwest corner of the Southeast Quarter of said Section 27; thence
South 8930'37" East, along the north line of said Southeast Quarter,
660.12 feet; thence South 028'37 West, 2612.02 feet to a point on the south
line of said Southeast Quarter; thence South 8917'06" West, along said
south line, 664.94 feet to the northeast corner of the Northwest Quarter of
said Section 34; thence South 006'43" West, along the east line of said
Northwest Quarter, 2618.44 feet to the southeast corner of said Northwest
Quarter; thence North 8917'43" West, along the south line of said
Northwest Quarter, 2640.16 feet to the point of beginning. Contains 460.27
acres, more or less.
is hereby rezoned from
District R-1aa (One-Family Dwellings) to District R-1a (One-Family Dwellings),
all as shown outlined on a map marked Section 80-11A0194, which is attached
hereto and made a part hereof, and which is hereby adopted as a part of an amendment
to the zoning maps constituting a part of said chapter and as an amendment to
Section 80-11 thereof.
Section B.
That the Council finds and declares that before taking any action on the
proposed amendment hereinabove, all public notices and hearings required by the
Zoning Ordinance have been given and had.
