COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 060097

 

Approving an amendment to a previously approved preliminary plan in District PD/C-3a1 on approximately a 2.6 acre tract of land generally located at the southeast corner of Admiral Boulevard and the Paseo. (11006-PD-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District PD/C-3a1 (Planned Development/Intermediate Business, Low Buildings) on approximately a 2.6 acre tract of land generally located at the southeast corner of Admiral Boulevard and the Paseo, and more specifically described as follows:

 

TRACT I: All that part of Lots 47 and 48, RANDON PLACE, a subdivision of land; All of Lots 1 and 2; All that part of Lots 3 through 7 both inclusive, Neiswangers Subdivision of Parts of Lots 47, 48, 49, 55, 56 and 57, Ranson Place, a subdivision of land, all in Kansas City, Jackson County, Missouri, all being more particularly described as follows: Beginning at the Southeast corner of said Lot 2; thence North 87 degrees 35 minutes 33 seconds West, along the South line of said Lot 2 and the South line of said Lot 3, a distance of 149.75 feet, to the intersection of said South line with the East right of way line of The Paseo, as now established; thence North 2 degrees 08 minutes 19 seconds East, along said East right of way line, a distance of 205.81 feet; thence continuing Northeasterly along said East right of way line along a curve to the right, tangent to the last described course, having a radius of 50.00 feet, a central angel of 90 degrees, 14 minutes 50 seconds, an arc distance of 78.76 feet; to a point on the South right of way line of Admiral Boulevard, as now established; thence South 87 degrees 36 minutes 51 seconds East, along said South right of way line, a distance of 99.53 feet, to the intersection of said South right of way line with the West right of way line of Flora Avenue, as now established; thence South 2 degrees 08 minutes 19 seconds West, along said West right of way line, a distance of 256.09 feet (Plat = 256.00 feet) to the point of beginning together with the North of the vacated alley lying south of and adjacent thereto.

 

TRACT II: All that part of Lots 56 and 57, RANSON PLACE, a subdivision of land in Kansas City, Jackson County, Missouri, described as follows: Beginning at the point of intersections of the North right of way line of 8th Street, as now established, with the East right of way line of the Paseo, as now established; thence North 2 degrees 08 minutes 19 seconds East, along said East right of way line, a distance of 173.02 feet (Plat = 173.00 feet), to the intersection of said East right of way line with the South line of an existing 16.00 foot alley; thence South 87 degrees 35 minutes 33 seconds East, along said South line, a distance of 149.75 feet, to the intersection of said South line with the West right of way line of Flora Avenue, as now established; thence South 2 degrees 08 minutes 19 seconds West, along said West right of way line, a distance of 173.05 feet (Plat = 173.00), to the intersection of said West right of way line with the aforesaid North right of way line of 8th Street; thence North 87 degrees 34 minutes 45 seconds West, along said North right of way line, a distance of 149.75 feet to the point of beginning, together with the South of the vacated alley lying North of and adjacent thereto.

 

TRACT III: All of that part of Lots 5, 6 and 7, Askews Partition of Part of Lots 44, 45, 46, 47, 57, 58, 59 and 60, Ranson Place, a subdivision of land, all in Kansas City, Jackson County, Missouri, described as follows: Beginning at the intersection of the South right of way line of Admiral Boulevard with the East right of way line of Flora Avenue, as said Boulevard and Avenue are now established; thence South 87 degrees 36 minutes 51 seconds east, along said South right of way line, a distance of 90.00 feet; thence South 2 degrees 08 minutes 19 seconds West, parallel with the said East right of way line of Flora Avenue, a distance of 269.13 feet (Plat = 269.00 feet), to the South line of said Lot 5; thence North 87 degrees 34 minutes 29 seconds West, along last said South line, a distance of 90.00 feet to the intersection of last said South line with the aforesaid East right of way line of Flora Avenue; thence North 2 degrees 08 minutes 19 second East along said East right of way line, a distance of 269.07 feet (Plat = 269.00 feet), to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri Licensed Civil Engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to Development Services prior to approval and issuance of any building permits, and that the developer construct any improvements as required by Development Services.

 

2. That the developer verify storm sewer capacity for a minimum of the next 4 downstream segments west of proposed connection along the Paseo, as part of the micro storm drainage study.

 

3. That the developer submit plans for grading and siltation and erosion control to Development Services for approval prior to the commencement of any construction activities.

 

4. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

5. That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

6. That the developer secure permits to reconstruct existing sidewalks, curb, gutter, storm sewers, and streetlights as necessary along all development street frontages, as required by Development Services, prior to issuance of a certificate of occupancy.

 

7. That any relocated streetlights be integrated into the existing street light system as required by Development Services.

 

8. That the developer provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

9. That the developer extend sanitary sewers to ensure individual service is provided to the westerly lot and determine adequacy as required by Development Services.

 

10. That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by Development Services.

 

11. That the developer submit a street tree planting plan prior to application for final plan, secure the approval of the City Forester for street trees planted on right-of-way in front of residential lots (with a copy to be submitted to the City Development Department staff), and agree to plant in conformance with the plan approved by the City Forester. The plan shall include size, type, species, and placement of trees.

 

12. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping (including the location of existing and approved street trees), signage including a free-standing pylon/monument sign set back at least 20 feet from the property line at the northwest corner which is no more than 150 in height with a base of 74 and sign face of 76 tall by 63 wide (including sign elevations), lighting (including a photometric study showing zero foot-candles along the Paseo, 7th Street/Admiral Boulevard and 8th Street), building elevations (including additional building enhancement consisting of double row brick soldier courses and brick pilasters along the Paseo), parking consisting of 88 spaces (including four accessible spaces) divided between the westerly and easterly lots and a striped pedestrian crosswalk on Flora Avenue between the parking areas.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
