COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 951297, AS AMENDED

 

Reducing appropriations in certain accounts by $60,000.00; appropriating $60,000.00 to the 18th & Vine Project; authorizing a third amendment to an agreement between the City and the 18th and Vine Authority, adding the amount of $284,000.00 for the purpose of constructing the 18th and Vine Project; designating requisitioning authority; authorizing acceptance of a special warranty deed in connection with the Project; directing the City Clerk to record the deed; and authorizing expenditure of funds in connection with the Project.

 

WHEREAS, by Ordinance No. 931426, the City Council authorized the creation of the 18th and Vine Authority (the "Authority") for management of the 18th and Vine Project, and directed the Director of City Development to enter into an agreement with the Authority; and

 

WHEREAS, the expenditure of additional funds by the Authority for construction of the Project on behalf of the City is necessary for construction; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the appropriations in the following accounts are reduced in the following amounts:

 

96-309-089-6301T Special Projects CD3 $30,000.00 96-309-089-7733T Blue River Flood Control 30,000.00

 

Section 2. That the sum of $60,000.00 is appropriated from the Unappropriated Fund Balance of the Capital Improvement Fund to the following account in the said fund:

 

96-309-064-6700T 18th & Vine Project $60,000.00

 

Section 3. That the Director of City Development is designated requisitioning authority for Account No. 96-309-064-6700-T.

 

Section 4. That the Director of City Development on behalf of the City, is authorized to enter into a third amended agreement with the 18th and Vine Authority, in an additional amount of $284,000.00, for a total contract amount of $914,400.00, for management of the 18th and Vine Project. The amended agreement is approved in substantial form as the attached exhibit.

 

Section 5. That the Director of City Development is authorized to accept a special warranty deed for the property described as:

 

Lots 22 and the north of Lot 23, Block 2, William Tom's Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

Section 6. That the City Clerk is directed to record the special warranty deed referred to in Section 5 in the office of the Recorder of Deeds for Jackson County, Missouri.

 

Section 7. That the Director of City Development is authorized to expend $224,000.00 from funds appropriated to Account No. 92-388-064-7350T, 18th and Vine/Jazz Hall Complex, and $60,000.00 from funds appropriated to Account No. 96-309-064-6700T for the amended agreement ($284,000.00) and property acquisition for the project ($16,500.00).

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
