COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 140975

 

Authorizing the City Manager to execute a ten year Intergovernmental Agreement subject to annual appropriation with Jackson County, Missouri and the Kansas City Missouri Police Department for Jackson County to house KCPD arrestees and City inmates at the Jackson County Detention Center (JCDC) and Regional Correctional Center (RCC); authorizing the City Manager to amend the Agreement without City Council authorization; authorizing the expenditure of $970,000.00 for capital improvements to the JCDC and RCC facilities from funds previously appropriated; and recognizing this ordinance as having an accelerated effective date.

 

WHEREAS, Resolution No. 080310 expressed the City Council’s interest in developing a regional correctional system; and

 

WHEREAS, Jackson County has housed City inmates and detainees at the Jackson County Regional Correctional Center (RCC) since the City closed the Municipal Correctional Institution (MCI); and

 

WHEREAS, Kansas City Missouri Police Department (KCPD) desires to house KCPD arrestees at the Jackson County Detention Center (JCDC); and

 

WHEREAS, Jackson County will make the necessary capital improvements to the JCDC to house KCPD arrestees and to the RCC to house additional City inmates and detainees and the City will fund the capital improvements; and

 

WHEREAS, Jackson County will provide all services necessary to house KCPD arrestees and City inmates and detainees over the ten year contract term; and

 

WHEREAS, it is in the best interests of the health, safety and welfare of the citizens of City, County and KCPD to continue to advance the concept of a Regional Jail for Jackson County and to enter into this Intergovernmental Cooperative Agreement; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is authorized to execute a ten year Intergovernmental Agreement that is subject to annual appropriation with Jackson County, Missouri and the Kansas City Missouri Police Department (KCPD) for Jackson County to construct City funded capital improvements to the Jackson County Detention Center and Regional Correctional Center to house 100 KCPD arrestees and 175 City inmates and detainees for ten years.

 

Section 2. That the City Manager is authorized to amend the Intergovernmental Agreement for any construction related issues and annual contract cost increases set forth in the Intergovernmental Agreement without additional City Council authorization with such funds as are available in the Adopted Budget(s).

Section 3. That the Administrator of the Municipal Court is authorized to expend for construction set forth in the Intergovernmental Agreement the sum of $970,000.00 from funds previously appropriated to Account No. 15-1000-272210-B.

Section 4. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date as provided in Section 503(a)(3) (D) of the City Charter and shall take effect in accordance with Section 503, City Charter.

  I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
