ORDINANCE NO. 070325

 

Authorizing a $689,057.00 contract with TEAM Excavating, LLC. for sanitary sewer improvements at 83rd Street and Oldham and 82nd Street and James A. Reed Road; authorizing the City Manager to expend up to $757,962.80 for the contract; and recognizing an emergency

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the City Manager is authorized to enter into a contract with Team Excavating, LLC, for $689,057.00 for sanitary sewer improvements at 83rd Street and Oldham, Project No. 89003505 and 82nd Street and James A. Reed Road, Project No. 89003450 in Sewer Districts 11031-36, 11023 and 11047

Section 2. That the work shall be done in accordance with the plans, specifications and the contract therefore between Kansas City, Missouri, through its City Managers Office, and Team Excavating, LLC., in the amount of $689,057.00, which contract is hereby approved and confirmed. A copy of the contract is on file in the Capital Improvements Management Office and is incorporated herein by reference.

  Section 3. That the City Manager is hereby authorized to expend up to $757,962.80 from the following accounts for the aforementioned contract and contingencies associated herewith

AL- 8181-807170-B-81000243 83rd and Oldham $152,745.24

AL- 8181-807170-B-81000244 82nd and James A Reed 267,670.44

AL- 8182-807170-B-81000244 82nd and James A Reed 17,007.66

07- 3090-808605-B-81000383 Assessment Subsidy 19,900.00

AL- 3390-898885-89003450 82nd & James A. Reed 284,678.10

AL- 3390-898885-89003505 83rd & Oldham Sanitary 15,961.36

TOTAL $757,962.80

 

Section 4. That the special assessments for 50% of the total construction cost of the sewer extension less $19,900.00 from Capital Improvement Sales Tax plus 25% of the total construction cost of the sewer extension for engineering and administration are hereby authorized to be made and levied upon the lands within Sewer District Nos. 11023 and 11047 according to the area rule and provisions of Article VIII, Section 814 of the Charter of Kansas City, relating thereto.

 

Section 5. That the special assessments for 50% of the total construction cost of the sewer extension plus 25% of the total construction cost of the sewer extension for engineering and administration are hereby authorized to be made and levied upon the lands within Sewer District Nos. 11031, 11032, 11033, 11034, 11035 and 11036 according to the area rule and provisions of Article VIII, Section 814 of the Charter of Kansas City, relating thereto.

 

Section 6. Special tax bills evidencing the amount of such assessments shall be issued to Kansas City and shall be credited to the Sewer Special Assessment Fund and when collected, the proceeds thereof shall be made payable in fifteen annual installments at such times and with such effect as is provided in Article VIII of the Kansas City Charter. The said special assessments shall bear interest at a rate per annum equal to the rate of ten year United States treasury notes as established at the last auction before the assessment is certified to the Director of Finance. If delinquent, said special assessments shall bear interest at a rate per annum two percent higher than the interest rate on assessments which are not delinquent.

Section 7. That this ordinance is recognized as an emergency measure within the provisions of Section 503 of the City Charter in that it is a public improvement, and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
