Approving a community unit project in District R-4 on
approximately a 36 acre tract of land generally located east of N. Platte Purchase Drive and south of N.W. 108th Street (13663-CUP-1)
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section A. That a
community unit project in District R-4 (Low Apartments) on approximately a 36
acre tract of land generally located east of N. Platte Purchase Drive and south
of N.W. 108th Street, and more specifically described as follows:
A tract of land in
the Northwest Quarter of Section 34, Township 52, Range 33, Kansas City, Clay
County, Missouri, being bounded and described as follows: Commencing at the
Northwest corner of said Northwest Quarter; thence South 03636 West along
the West line of said Northwest Quarter; 1500.09 feet; thence South 672824
East, 923.31 feet to the True Point of Beginning of the tract to be herein
described; thence North 511347 East, 700.18 feet; thence North 853507
East, 452.41 feet; thence North 650603 East, 620.07 feet to a point on the
East line of said Northwest Quarter; thence South 03350 West along said East
line, 1516.60 feet to the Southeast corner of said Northwest Quarter; thence
South 894735 West along the South line of said Northwest Quarter, 1034.94
feet; thence North 01225 West, 327.02 feet; thence North 344246 West,
367.71 feet; thence North 622053 West, 337.52 feet to the True Point of
Beginning. Containing 35.93 acres, more or less.
is hereby approved, subject to
the following conditions:
1.
That the developer cause the area to be platted and processed in
accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
2.
That the developer submit a macro "overall" storm
drainage study for the entire Park Place North development to Development
Services for review and acceptance prior to submittal of the first plat
application. That a micro "detailed" storm drainage study to be
submitted for each named phase of the Park Place North development at the time
of first final plat application be submitted for that named phase, and that the
developer construct any necessary improvements as required by Development
Services.
3.
That the developer design and construct all interior streets to
City standards as required by Development Services, including curb, gutter,
storm sewers, streetlights, and sidewalks.
4.
That the developer obtain the grading consents, and all grading,
temporary construction and drainage/sewer easements from the abutting property
owner prior to submitting any public improvements.
5.
That the developer subordinate to the City all private interest
in the area of any right-of-way dedication as required by Development Services
and that the developer be responsible for all costs associated with
subordination activities.
6.
That the developer construct temporary off-site cul-de-sacs as
required by Development Services.
7.
That the developer submit a street name signage plan for the
entire Park Place North development for approval by the Street Naming Committee
prior to submittal of the first final plat for any named phase.
8.
That the developer submit plans for grading, siltation, and
erosion control to Development Services for approval and permitting prior to
beginning any construction activities.
9.
That the developer secure a land disturbance permit from Development
Services prior to beginning any construction, grading, clearing, or grubbing
activities, if the disturbed area exceeds one acre.
10.
That the developer extend sanitary sewers to ensure individual
service is provided to all proposed lots and determine adequacy as required by
Development Services.
11.
That the developer provide a storm water conveyance system to
serve all proposed lots within the development and determine adequacy as
required by Development Services.
12.
That the developer submit covenants, conditions and restrictions
to Development Services for review by the Law Department for approval for the
maintenance of private open space and enter into a covenant agreement for the
maintenance of any storm water detention area tracts.
13.
That with the application for final plat, the developer submit a
street tree planting plan as part of the final plat, with a copy to be
submitted to the Department of City Development; and further, that the
developer secure the approval of the City Forester for street trees planted on
right-of-way in front of residential lots and plant the street trees in
conformance with the plan approved by the City Forester. The plan shall
include size, type, species, and placement of trees.
14.
That the developer submit a final
community unit project plan to the City Plan Commission for approval including
plans for landscaping, grading, signage, screening, berming, fencing, and
building elevation drawings.
15.
That no more than 50 residential
units will be allowed to be constructed until there are at least 2 points of
access to the public arterial street system.
A copy of said Community Unit
Project plan is on file in the office of the City Clerk with this ordinance and
is made a part hereof.
Section B. That the
Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
