ORDINANCE NO. 030966

 

Approving a Community Unit Project on an approximately 1.5 acre tract of land generally located 600 feet east of N.E. Searcy Creek Parkway on the south side of N.E. Parvin Road. (12937-CUP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 1.5 acre tract of land generally located 600 feet east of N.E. Searcy Creek Parkway on the south side of N.E. Parvin Road, and more specifically described as follows:

 

All that part of the Southeast Quarter of Section 5, Township 50, Range 32, in Kansas City, Clay County, Missouri, described as follows: Commencing at the southeast corner of the Southeast Quarter of Section 5; thence North 0E33'12" West the east line of said Southeast Quarter for 382.29 feet for the point of beginning; thence South 89E24'48" West parallel to the south line of said Southeast Quarter for 221.02 feet; thence North 0E33'12" West parallel to said east line for 82.47 feet to a point 464.76 feet north and 221.02 feet west of the southeast corner of said Southeast Quarter; thence North 17E23'01" West for 147.49 feet to the south right of way line of Parvin Road (100 feet right of way); thence North 69E50'57" East along said right of way line for 163.94 feet tangent to a curve to the left; thence along said curve, radius 2914.79 feet, delta 2E17'52", for 116.89 feet to the east line of said Southeast Quarter; thence South 0E33'12" East along said east line for 320.00 feet to the point of beginning. Containing 64,883.57 square feet or 1.490 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit an overall storm drainage study to the City Engineers Office for approval regarding both proposed developments at the time the first final plat is submitted, with detailed storm drainage studies to be submitted for each phase of development at the time of final platting, and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer obtain the grading consents, and all grading, temporary construction and drainage easements from the abutting property owner prior to submitting any public improvements.


5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

7. That the developer obtain a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities within the floodplain.

 

8. That the developer construct a sidewalk along the south side of N.E. Parvin Road as required by the Department of Public Works.

 

9. That the developer contribute $2,896.70 in lieu of parkland dedication for 19 multi-family units (19 x 2 x 0.006 x $11,389.05) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

10. That the developer extend and/or enlarge water mains and provide easements as required by the Water Services Department.

 

11. That the developer extend sanitary and/or storm sewers and determine adequacy as required by the Department of Public Works and Water Services Department.

 

12. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

13. That the developer submit a final plan to the City Plan Commission for approval including detailed information on grading, landscaping, signage (including elevations), and building elevations.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 030966, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
