ORDINANCE NO. 130939

 

Approving a development plan in District DX-15 on approximately a 1.2 acre tract of land, generally located north of 16th Street between Main Street and Baltimore Avenue. (14423-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a development plan in District DX-15 (Downtown Mixed Use (dash 15)) on approximately a 1.2 acre tract of land, generally located north of 16th Street between Main Street and Baltimore Avenue, and more specifically described as follows:

 

Lot 4, except the north 23.02 feet thereof, Lots 5, 6, 7, 8 and 9, all in Block 1, J.H. McGee's Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof; together with the west half of the vacated alley lying east of and adjacent thereto, and Lots 223, 224, and 225, except that part of said lots now in Main Street, all in Block 16, McGee's Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof; together with the east half of the vacated alley lying west of and adjacent thereto. All being more particularly described as follows:

 

Beginning at the southwest corner of said Lot 9; thence North 02 degrees 08 minutes 09 seconds East along the west line of said Lots 4, 5, 6, 7, 8 and 9, 276.94 feet; thence South 87 degrees 10 minutes 28 seconds East, 112.46 feet to the centerline of said vacated alley; thence South 02 degrees 34 minutes 34 seconds West along the centerline of said vacated alley, 128.40 feet; thence South 87 degrees 13 minutes 48 seconds East along the north line of said Lot 223, 138.12 feet to the west right-of-way line of Main Street, as now established; thence South 02 degrees 19 minutes 00 seconds West along said right-of-way, 148.66 feet; thence North 87 degrees 10 minutes 28 seconds West along the south line of said Lots 225 and 9, 249.13 feet to the point of beginning. Containing 51,421 square feet or 1.18 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, as amended.

 

2.                  That the developer submit to the Land Development Division, 5th Floor of City Hall, a Storm Drainage Report from a Missouri-licensed civil engineer evaluating proposed improvements and impact to drainage conditions. There shall not be an increase to historical runoff conditions from the site and since this project is within a “Combined Sewer Overflow” (CSO) district, the expectation is to retain 1.5 inches (prevalent storm event in KC) per acre over the site as a means of reducing negative impact to the aging sewer systems that might otherwise result from runoff generated by the development. Drainage study should verify if any modifications to public sewer structures are required and that downstream conditions will not be impacted negatively as a result of engineering impact. The study shall be submitted prior to approval and issuance of any building permits and prior to recording the plat. The developer shall provide for construction of improvements as required by the City Development Department.

 

3.                  That the developer verify adequate capacity of the existing sanitary or storm sewer systems as required by the Land Development Division, prior to issuance of a building permit to connect private systems to the public sewers if applicable, and depending on adequacy of the receiving system make other improvements as may be required by the Water Services Department. Owner/developer shall obtain a permit from the Land Development Division, prior to beginning construction within the public right-of-way and prior to recording the final plat.

 

4.                  That if public streetlight relocation(s) are necessary, the developer will provide public street lighting plans for integration into the existing streetlight system, as required by the Land Development Division. Owner/developer shall obtain a permit from the Land Development Division, prior to beginning construction within the public right-of-way and prior to recording the final plat.

 

5.                  That the developer secure a site disturbance permit (SEC8) from the Land Development Division prior to beginning any construction, grading, clearing or grubbing activities, if the area to be disturbed exceeds one (1) acre.

 

6.                  That the developer also secure a site disturbance permit from the Missouri Department of Natural Resources if the area to be disturbed for the entire development exceeds one (1) acre.

 

7.                  That the developer submit plans for grading, siltation and erosion control to the Land Development Division for review and approval prior to beginning any construction activities.

 

8.                  That the developer submit a streetscape plan for review and permitting by the Land Development Division, 5th Floor, City Hall, prior to beginning construction within the public right-of-way. A permit by the Land Development Division, 5th Floor, City Hall must be obtained by owner/developer, prior to beginning construction within the public right-of-way and prior to recording the final plat.

 

9.                  That the developer submit a recorded “Conveyance of Easement for BMPs” to show location, design, and owner maintenance obligations for the on-site BMP(s) required to serve CSO retention and attenuation goals for development stormwater runoff. Easement will be reviewed and processed by the Land Development Division for acceptance by the City, prior to recording the final plat.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
