ORDINANCE NO. 050816

 

Authorizing the Director of the Department of City Development to enter into an agreement with the U.S. Army Corps of Engineers, Kansas City District to fund one staff member to support the City Brownfields Program; and accepting $50,000.00 of additional in-kind staff support services for the City Brownfields Program from the Corps through funds provided by the U.S. Environmental Protection Agency.

 

WHEREAS, the U.S. Environmental Protection Agency has consistently supported the City Brownfields Program through the total award of over $2.5 million in grant assistance and technical support to facilitate Brownfield assessment, cleanup and redevelopment; and

 

WHEREAS, the City Brownfields Program currently consists of one full-time staff member, the Brownfields Coordinator, operating within the Division of Economic Development and Business Assistance in the Department of City Development; and

 

WHEREAS, EPA, Region VII has entered into an Inter Agency Agreement to provide the U.S. Army Corps of Engineers approximately $50,000.00 to fund a Corps staff member to support the City Brownfields Program on a part-time basis for 12 months; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. The City, through the Director of City Development (Director), is hereby authorized to enter into a Memorandum of Agreement with the U.S. Army Corps of Engineers, Kansas City District (Corps) to provide staff support services for the City Brownfields Program for a period of twelve (12) months from funds previously appropriated to Account No. 06-1000-642200-B. A copy of the agreement, in substantial form, is on file in the office of the City Development Department.

 

Section 2. The Director is further hereby authorized to enter into an employment contract for a period not to exceed twelve (12) months with a Corp staff member identified pursuant to the above referenced Memorandum of Agreement.

 

Section 3. The Director is further authorized to accept approximately $50,000.00 worth of in-kind Corps staff services in support of the City Brownfields Program pursuant to the above referenced Memorandum of Agreement and funded by a separate Interagency Agreement between EPA and the Corps.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
